  1. HI, I was in the US on L1-B from Jan 2011 to Oct-2014. I had a COS H1-B application filed from Consulting firm A which was approved for 2014 Cap. I worked for a couple of months and left US in Dec 2014. That leaves about 2.2 years of H1 time that could used. Consulting firm B filed for my H1 in April 2020 which was approved till Aug 2022. As there was a ban because of CoVid, I could only go for a stamping in April 2021. My Visa was stamped from April 2021 till Aug 2022. I got a FTE offer and from a new employer C, and they have started the paperwork. If the petition is approved, do I have to reappear for Visa Interview, or, can I travel with my current Visa stamping and a new I-797? I haven't travelled on the new stamp so far. The stamping has Consulting Firm B's name on it. Appreciate your time. Thank you! SamC

  3. Hi, I first entered US on a L1 and moved to H1-B after close to 4 years. I got my H1 approved without Consular processing and moved to a new Job in the US immediately. I stayed in the US on H1 for only 71 days. I have been out of US for more than 6 years now. Will I be able reclaim 5 years 10 months on 6 years or would it just be 2 years that I can reclaim?

  5. I was in the US from Jan '11 till Dec '14. I landed on a l1B and filed for my H1 in 2014. My petition was approved and I moved to H1B in Oct '14. My petition was approved from 10/01/2014 till 03/26/2017. I moved back to India in Dec '14. I am in India since then. Can I file under Cap exemption? If yes, should I be filing before 1st oct 2020 or 25th Mar 2023?
