    H1B Premium for extension

    My current H1B expired in the 3rd week of May 19. I did not file for an extension earlier as the premium processing was supposed to be halted from Sept-18 thru Feb-19. My I-140 is approved. Now, even in March-19 the premium processing has not be reinstated. I have provided all the documentation to the immigration attorney and they are planning to file H1B extension in the next week. 1) When do we anticipate H1B premium processing to be renewed? I know it depends on the USCIS, but you experts may have some idea. Any constructive responses much appreciated. 2) My Drivers License(DL) expires with the H1B expiry. I am worried about it because I don't have any ride to my work. I know this happened because the delay in filing my H1B. Is there any option for getting DL renewed without valid extension? Do I have any options at all? Any constructive feed back much appreciated,

    H1B - Travelling outside USA

    I am on H1B currently and my I-140 has been approved. I am planning to go to India to get married. I am not sure about how the H1B stamping is gonna go. Please let me know, 1) What happens if my H1B stamping is rejected? My prospective spouse is a US Citizen. 2) Can I apply for Fiance visa from India? My prospective spouse is a US Citizen. 3) How long does it take for me to get green card from India? My prospective spouse is a US Citizen.
  3. Hi Experts, Can a person on H1B choose to take an unpaid leave of absence without falling out of status? What are the conditions for this? What should be the format of approval for this and should it be an email approval or physical copy approval? Can the approval be taken after salary(less than LCA) is credited? Please guide.

    H1B Dual Payroll Issue

    Current Employer - Filed H1B Amendment. New Employer - About to initiate H1B Transfer. Current Employer has a 2 week notice period clause in the employee contract. New Employer wants me to join before the H1B transfer is successful, i.e. as soon as transfer receipt number is received. H1B Transfer would be filed in premium. I am not planning to give the current employer notice until H1B transfer thru new employer is successful. The problem here is, I would start working for the new employer as soon as I get the receipt number without informing the old employer. 1) By the time I would give notice, I would have started working for the new employer, I would be on a leave/vacation of the old employer. This would mean that for 15-20 days, I would be on the payroll of both old and new employer. Would this cause any issue in the H1B for the future or Greencard processing or W-2 and taxation? 2) If my H1B transfer is denied, can I go and join old employer as if I was really on a vacation and did not join the new employer? 3) If my current employer decides that he wants to revoke my H1B today(8th May 2016), what would be the nearest revocation/cancellation effective date he can request? 4) If the current employer revokes H1B before the new H1B transfer is completed( but already initiated) will it be a problem?

    Planning to apply H1B Transfer

    I am planning to give the old employer notice only after H1B Transfer is approved. Due to this, I will be on the payroll of both old and new employers for few days. Will that cause an issue?

    Old employer taking legal action

    1. Yes. This is cool off period and strictly enforced by Desi consulting companies to avoid losing people like you to the end client. 2. Consult a lawyer. Generally the previous employer should be expecting some money in the form of out of court settlement. 3. Better you be ready to pay the money, negotiate to as low as possible. Note: This is not a legal advice but just a suggestion based on my experiences and research

  12. Hi Experts, I am planning to apply H1B transfer thru new employer. I am with my current employer but moved to a new location. The current employer has submitted LCA and mentioned that he needs to file h1-b amendment. The current employer is asking document from me for that. Please let me know about, 1) What happens if h1-b amendment is not filed by current employer after I submit documents?   13. H1B LCA has been posted. H1B transfer Petition will be filed only in 7-8 business days by new employer. I am not sure when will I get the receipt number from new employer. My current employment has notice period of 2 weeks notice. Before my H1B transfer is filed, if I give 2 week notice period, can the my previous employer cancel the original H1B IMMEDIATELY and prevent my H1B transfer from happening? Can the revokation be effective on the same date i resign or it will take sometime?
