  1. Hi, Today is 06/18/2019, and I’m looking to travel out of the country on 12/08/2019 and then return back to the USA on 01/22/2020. My current H1b with my employer would expire on 06/14/2020. I do already have H1b visa stamping until my visa expiration date. As my H1b expires in less than 6 months from my return date to the country. Is it safe to travel? Is there any such rule for an H1b candidate that they are not allowed to travel if their visa expires in less than 6 months? Also, with my current travel plan, when is a good time for my employer to file my H1b extension?

    H4 visa stamping

    Hi, I'm on a H1b with an employer A and my current I-797 is valid till 2019 Nov. In July 2017, I was hired by an employer B, and they filed for a H1b transfer in July 2017. My H1b transfer status: USCIS issued an RFE and then the Employer B had responded to them, USCIS is in the process of reviewing the case as of 12/04/2017. My wife obtained an H4 approval notice through employer A, and it is also valid till 2019 Nov. A new H4 petition hasn't been filed yet (through employer B) Questions: 1) My wife is currently in INDIA. Can she go for H4 stamping using her current approved I-797 through employer A (which is valid till Nov 2019)? If yes, then when I was trying to look for h4 visa dates, there was a field name in one of the page that says "Petitioner name". Which petitioner should I mention over there i.e. employer A or B? 2) Do I really have to file for another H4 petition now, or after my H1b transfer gets approved, even though her current h4 petition is valid till Nov 2019? Please help! Thank you!

    H1b Transfer

    Hi, I'm currently working for a Client A through Employer 'X' (who holds my H1b) and my current visa is valid till Nov 2019. I'm planning to transfer my h1b to a Client A (direct hire). My i-140 has been approved with Employer 'X' on Sep 2014. My h1b 6 yr period will be completed by sep 30, 2018. Questions: 1) If I wish to transfer my h1b to Client A using the existing I-140 approval notice. would I get 3 years? My employer 'X' indicated that they would be cancelling the i-140 after a month or two after leaving the company. so since the h1b premium processing is currently suspended. The transfer process could take 3-6 months, so during the middle of the h1b transfer process, if USCIS finds out that the approved I-140 has been revoked by an employer. Do they be still be able to grant me 3 yrs of h1b or just only until sep 30, 2018? 2) Let's say the transfer gets approved until sep 30 with Client A, 2018. Does my green card PERM & i-140 at Client A needs to be filed & approved by sep 30, 2018 or anytime? (Employer X indicated they cannot hold my i-140 more than 2 months). Please help. Thank you!

    Hi, I'm currently working for a Client A through Employer 'X' (who holds my H1b) and my current visa is valid till Nov 2019. I'm planning to transfer my h1b to a Client A (direct hire). Once the transfer gets approved and I will be starting to work for Client A (who will then hold my new h1b). Client A is the non-profit organization. Employer X is the profit organization. Questions: 1) If I transfer my h1b visa from a profit organization to a non-profit organization, will there be a problem for my h1b transfer? 2) After h1b transfer to Client A and 1-2 years of working at Client A. If I wish to switch back to Employer X ( which is a profit organization), will there be a problem for my h1b transfer? Please help. Thank you!

Once the transfer gets approved and I will be starting to work for Client A (who will then hold my new h1b). Questions: 1) After my H1b transfer to Client A, does the H4 dependent visa will also need to be transferred or not required? 2) After 1-2 years of working at Client A, If for some reason I do not like it and Can I go back and re-join Employer 'X' company since my previous h1b visa is still valid with my previous employer 'X'?
