Luckily employer applied the extension on Aug 8 2018 and said i wont be out of status now. as my I94 is ended on aug 7 and we got the receipt on aug 8. is it still ok. 1) Is it legal to work after I-94 expiry with labor approval and receipt number? 2) Total employer negligence is Caused this. Will My H1B will approved without RFE for the same reason i.e received date after I-94 expiry date. 3) If not legal to work and I had to return back to my country, then what are the impacts for future visa if I may have to apply ? 4) Can i change the employer if there is any RFE. 5) is it better find a new job and change the employer as soon as possible. 6)Is my stay considered as unlawful presence , even though i have H1B approval notice until Nov 26 2018 . 7) what is the best solution for me to do in this situation.
  5. Hi All, My H1B visa got expired on 7/28/18 and I-94 was expired on 8/7/2018. My company tried to get LCA approval one week before day of expiry. Hence, LCA approval on Last of day I94 Expiry. i.e. 8/7/2018. I have valid H1B approval notice until Nov 26 2018. LCA approved same day(8/7/2018) on my I-94 expiry same day. My company filed for extension on 8/7/2018 but the received date is 8/8/2018 . That is, 1 day after I-94 expiry. I got the receipt number on 8/8/2018. My company told me, since I have labor approved and have receipt number, it is legal to work. Questions - 1) Is it legal to work after I-94 expiry with labor approval and receipt number? 2) Total employer negligence is Caused this. It is getting very to aug 7 , I am concerned about this and asked my employer to fill the H1b extension , he said he will be sending the petition before Aug 7 , hope fully this friday.   11. Hi , I entered into US on Feb 11 2018, and i got new i94 valid until Aug 7 2018 . But i 797 is valid till Nov 2018. My wife has the visa until Nov 2018 and her new i94 is valid until Aug 7 2018. Currently my employer is planning to send the H-1B extension packet along H-4 extension before Aug 7 2018. After Aug 7 2018 , will we both are out of status ? I am little concerned
  12. Hi My visa stamp expires on July 2018 with Emp A, but i have approved H1-b Valid until Nov 2018 with EMP B. Currently i am with Emp B Q1. I am planning to visit india in Feb 2018, Do i Need to Go Re stamping process as , i have only 4 months valid visa stamp. Q2. I have applied I140 , Currently in Pending, Status, If it is approved Do i Need to wait until 6 months after the approval to have not revokable by employer. I have seen some post , employer can withdraw the I 140 after 180 days, If My Employer withdraws I140 , Will affect my priority Date. Q3. I am planning to change the employer B to Full Time, Say eg in Mid of 2018, Do i need to wait for the extension to applied by current employer or my new employer will take care of it.

    Old employer asking for $10K

    I am also in Similar Situation, I know that i need to bear the 10K if i terminate the job at client. i am moving to vendor for full time. My Employer is based in CA , i am working at the client location in Texas . does this agreement is in still affect. The Agreement is as follow "Employee agrees that in the event of a breach of this agreement during the first 18 months of its term, it would be impracticable or extremely difficult to fix the actual damages and, therefore, Employee will pay to the Employer, as liquidated damages, and not as a penalty, the sum of $10,000.00, which represents a reasonable compensation for the loss incurred because of the breach."

    MTR filing and New H1 B with Same Client.

    Yea, I going with vendor , they are filing H1 with client .. And also my employer filing H1 as in house as a backup H1 as it is lottery,..
