  1. @gremlin The reason for my initial denial is my petition is not eligible for specialty occupation. I have then consulted Murthy Law Firm and they helped me by providing additional documentation, SOW and affidavits from my employer, client as well.. i have filed my MTR/Appeal on Sep 3rd 2014...and we haven't reached USCIS till now for the update.

Hello Guys, I am in same boat..i have filed I-290B appeal on Sep 3rd 2014 and on nov 5th i saw change of case status on old receipt as your I-129 has been reopened...last week on thursday i.e on Nov 27th i saw an update on case status on New receipt as your I-290B has been approved and we will mail your approval notice... What does this indicates?..
  4. This is very confusing...the parallegal from murthy law firm says..having I-290B as approved doesn't mean a H1B approval..can any one please help... Dear Nag, Thank you for the update. The case status means that the Motion to Reopen your underlying H1B petition was approved. Unfortunately, a case status that says that the I-290B was approved does not necessarily mean that the underlying H1B will be approved. I checked the case status for the underlying H1B petition (using the older receipt number) and it does not appear that a decision has been made regarding whether your H1B petition will be approved, although it does acknowledge that your case was reopened. Please feel free to take a look at the case status for the underlying H1B petition on the USCIS website and let me know if you have any questions. Thank you!
  5. i290B notice of appeal case status changed to approved. Hi Friends, I was tracking my new case status today and i see the status as My case got Approved. on Nov 24th, 2014 we approved your Form I-290B, Notice of appeal to the commissioner, Receipt num xxx, we will mail your approval notice. please follow instructions in the notice. my old case shows as i129B has been reopened... I believe this indicates my H1B got approved correct ?

If you have not received the notice within 30 days of the date above, please call customer service at 1-800-375-5283 for further assistance.     @Attorney_23 My Employer has agreed to file MTR with murthy law firm. in order to evaluate whether if the petition have chances for a successful MTR, what are the documents does murthy attorney's are required from the employer.

    @Attorney_23 the employer is willing to file MTR for me with their respective attorney. as per employer the reason for denial looks be " The Desired job is not eligible for a specialty occupation worker"..my eductaion background bachelor's in Electronics and Communication and i didmy masters in Engineering Management. the occupation mentioned in the letters as System Administrator. can you pls help on my chances in supervisor review.

    @ Attorney_23 Thanks a lot for replying me.. yeah i am sure i wont be able to file MTR without my employer... as per my employer the current update he gives is that my application is the attorney has opened an sr for SR review and its still under supervisor review. can you please help how effective would be a supervisor review is ? or in any way how can we get a confirmation of whether an SR opened for my case or not i am in plan of hiring an attorney from murthy law firm right now. will my attorney from murthy law firm can help me in getting the letters from my employer legally ? i am in process of convincing him for hiring my own attorney as well.

    H1B Denial.

    Hello All, i have applied for h1b this year but my h1b got denied. i am trying to engage murthy law firm for filing MTR. i have been trying and trying to get the letters from my employer but they are reluctant to share the letters to me. will i be able to get any help from murthy law firm in getting the letters from my attorney. as per law i have every right to ask for letters but i am just getting helpless situation here. request for suggestion.

    @jairichi My H1b job profession is system administrator. in order to possess this we need a minimum of bachelors degree or equivalent experience. @all i have opt ending on dec 3rd. can any one please suggest its better to join college in this fall 2014 or spring jan 2015.

Hi all, trying to reach you guys for help for my issue. i have applied for H1B this year and i have received RFE asking for 1. new vendor letter 2. new client letter showing that i am working till 2017 and how my qualification is a requirement for the job. my employer had some issues with vendor and he delayed in providing the dates. at last my employer responded to RFE on july 23rd and my status got changed to Initial review on July 28th. After one week on Aug 4th. employer confirmed me that my H1 got denied. the reason he's mentioning to me ias uscis s my qualification is not a requirement for the job i am possessing. as per my employer he says in both letters he mentioned he has a the required bachelors degree. i am trying to get the denial letter from attorney as well....right now attoreny has opened a SR for supervisor review. my educational background is i have done bachelor's in Electronics and Communications and i did masters in Industrial Management. I request to please help any suggestions would be a great help.
