  1. It is related to showing proof of continuous employment authorization from the day my H1B expired in June 2010 till date. I have a gap and that is a worry.
  2. Although I returned and worked on L1 visa as AP was expired, after returning, I got AP / EAD renewal based on pending 485 (C09).

The period when I had no employment Authorization documents (Sep 2012 - May 2014) is when I was out of US and not working in US. Q: will the gap of staying out of US for 3.5 years while 485 is pending, returning to US on valid L1 visa but from different employer and reactivating EAD/AP on pending 485 (renewed twice) after return make any negative impact to the case?

  5. I was on H1 from Yr. 2000-2010 with same employer. I Possessed active EAD from 2008-2012 I went back to India with my active EAD, AP in Nov 2010. Worked in India until May 2014. My EAD, AP got expired while I was in India. Came back to US on L1 visa in May 2014. Once came back, Re-Applied and got my EAD and AP based on Pending I-485. Quit the L1 employer in Nov 2016. Started working on EAD since then... In summary, I did not possess Active EAD/Visa when I was out of US and working in India between Nov 2010- May 2014. However, my 485 is still pending. My PD is Mar 24, 2005, may get RFE soon... If asked in RFE for EADs/797s/continuous employment since 485 applied, Will this gap of 3.5 years when I was out of US impact?

Regarding Renewal of expired EAD/AP & returning to US on different Visa Category I140 :: is Approved on April 9, 2007 (H1B) I-485 :: is pending since October 9, 2007 (H1B) EB3 Category, Labor filing date March 20, 2005 (H1B) I was on EAD & AP before returning to India in November 2010. My AP & EAD has been expired since Yr. 2012. I came to USA on different visa cateogy L1A on May 6, 2014 through a different Employer. Question: Even though my EAD & AP has been expired for more than 2 years & now I am back in USA on different visa Category (L1A), can myself & my wife still re-apply for EAD based on my already Approved I-140 & pending I-485 case & earlier expired EAD?
