    H1B approval for concurrent

    Sorry, they got concurrent H1BB approved and today they have send application for cap petition. So can I start working for them with the approved concurrent H1B or do I have to wait until I get the cap one also approved before I can start working there?
  2. I have a valid cap-exempt H1B from company A. Now company B (cap-subject) filed a concurrent H1B and got approved. If I want to work for company C, do I have to compete in cap again becasue my cab was for concurrent employment? Thank you.
  3. I did it and currently I am working with the new employer. The overlap should be 15 days then I have to go back to my old emploer and resign.

Go back to the new employer and stay there normally. Any comments?

Another example would be to have the foreign national enter into or continue in an employment relationship with a cap-exempt institution while at the same time filing for concurrent H-1B status with a cap-subject employer. Since the statute (8 U.S.C.'214(g)(6)) references that a foreign national is subject to the H-1B cap if he 'ceases to be employed' by a cap-exempt institution, concurrent employment with a cap-exempt and a cap-subject employer does not involve 'ceasing employment' and therefore arguably renders the foreign national exempt from the H-1B cap.

  9. Hello All: I have the following question bothering me and I would like to get the Murthy Law community’s input about it. I work for a camp-exempt employer (A) on H1B that is valid until May 2014. I have received a job offer from cap-subject company (B). Can company B file for my H1B transfer and I can start working for them before October 1st? The attorney told me they can submit a concurrent H1B employment petition to transfer my H1B and extended it. He also told me once I get a visa number, and if my H1B gets approved I will have to take a 3 weeks’ vacation from my current employer A and go to work for the new employer for these 3 weeks. Then I have to come back to my original cap-exempt employer and resign and go work for employer B permanently. Have anyone seen something like this before? Thank you, -MH

Must have CCNA (Cisco Certified Network Associate) or higher certification. Must have the ability to work 2nd shift, split shift or other flexible hours in order to maintain the network. Must have the ability and willingness to be on call and reachable. Knowledge can be gained through coursework. RESPONSIBILITIES: Works closely with the Network Manager to provide a high speed, reliable and secure network. Install and support routers, switches, access points and other network related equipment and software. Troubleshoot Tier 2 and Tier 3 infrastructure problems. Create and maintain appropriate network documentation. Assist with the operation of network security equipment and software. Work with part-time student workers to maintain the proper functioning of the network environment. Please comment, I just want to make sure before desiding on staying around. Thanks.
