    H1b stamping 221g please advise

    Consulate contacted me 45 days after the interview to submit the documents. I have emailed the Consulate the original petition (that has the old client details) and supporting documents such as. Attorney letter why amendment is not needed, Google maps. I have not heard back anything after that. 1. When emailing the documents, since the H1B packet was more than 200 MB, my gmail automatically added it as google drive link. The rest of the documents are attached in pdf. Is it normal that google drive link be sent to the consulate. 2. Is my case a complicated one to adjudicate visa in the sense does Consulate need more time than normal to verify since my petition client is different from my current client. Note I have emailed the end client letter as well contract between employer and middle vendor as those were also asked for. 3. Is there a chance Consulate would come back asking me to submit amended petition in spite of the supporting letters and documents that were emailed.

    Hi Lakshma19 Based on what happened to me, you will be contacted for documentation to be submitted once Consulate does its first round of admin processing. Also for checking the status try case number in this format 2019XXX XXX XXXX Either case number or DS160 confirmation number can be used for checking the status.
  3. My H1b visa is under admin processing (given 221g blue slip). The client in my USCIS I129 petition is different from the one I am working with currently. The petition has my previous client details. Also my previous project was in EC model and current one is in EVC model. Since my new (current) client location is within the same MSA as previous client, my company/attorney told it is not required to file an amended petition. Please note my salary and job duties are same as with my previous client. Before going to the visa interview, my attorney gave me detailed letter addressing the Consulate and as well as gave supporting documentation explaining why an amended petition was not needed which I can give to the visa officer. During the interview, I was asked only 5 questions : i) petitioner's name, ii) client name, iii) project details, iv) salary and v) if I have a middle vendor. I told the current details regarding - client , project and the name of the middle vendor. No other question or document was asked for. The VO gave me a blue slip after talking to another officer. She also returned the passport. When I asked the VO officer if she would like to take a look at the attorney's letter of explanation, the VO officer told she does not need any document at this time and that I will be contacted if any document is needed. It has been 1 month since I have attended the interview and none of us - employer, middle vendor, client or I were contacted so far. Please let me know - 1) If mine falls under the complex case category with regards to verification and if so how long it would take for the verification to complete. 2) Since the visa officer did not take any documents from me (like the employer letter, vendor letter, client letter), how will the Consulate know whom to contact for verification. 3) Is there anything my attorney can do like emailing the letter of explanation to the consulate. I am just seeing if there is any way we can provide details in writing since all I was asked were the 5 questions mentioned above and no documents taken from me.

    Son going for H4 interview

    My husband will be going for his H1 stamping this summer. He has been working in US for past 10 years. About 3 weeks later, my son who is 16 years old will be going for H4 stamping alone without his dad or me accompanying him. Can you please reply to the below questions. 1) Please let me know all possible documents my son should take to the consulate. 2) Also please let me know the possible visa interview questions he will be asked.

  7. My H1b PP COS received RFE and my employer's attorney seems to have submitted the evidences last week. I am guessing last week because my attorney mentioned a couple of days back that I may get the approval by mid next week. My Case status continues to show Request for Additional Evidence Notice Was Mailed. I am expecting the status should by now be either Request for Evidence Respond Review or Initial Review. It is important for me to get the approval next week itself, hence the tension. Can someone who has got their approval submitting response to RFE after the uscis website change (in Nov) please share their experience. Did the status change to approved directly from Request for Additional Evidence Notice Was Mailed.

  10. Anshul, based on my own experience, it is possible that the employer has received notification that your petition has been approved. They must be waiting for the hard copy to be mailed from US attorney office. But also consider advise from others as well.

    I'm still waiting. My case status still shows "Request for Additional Evidence Notice Was Mailed". Sure will let you know if any change in status. Between, my case's Next Steps states "We will review your response to our request and mail you our decision." Not sure whether to assume the above as acknowledgment from USCIS that they have received the evidences. Please let me know if your status changes to either "RFE Review phase" or "Approved (Final decision).

    H4 to H1 RFE

    Hi My first-time H1B got approved this year. It was filed as Consular processing. I was working in India and came to US on H4 this summer. My H1 employer decided to do change of status from H4 to H1 of the previously approved H1 petition. The COS application got RFE from uscis and the company's attorney is working on it. Can you please answer the following questions. 1) If I need to go back to India before the COS result is known or I go back after the COS is denied (just in case), is it true I'll be able to attend visa interview using the previously approved H1 CP petition. 2) If I come to know my COS is denied before I go back to India, will any other employer be able to transfer my H1b CP petition that was previously approved.   14. My husband's 7th year H1 extension and my H4 have been filed and we are awaiting receipt notice. His existing H1 petition expires on Sep 25. My H1 employer is planning to file COS from H4 to H1 in the next few days. Please let me know if there would be a problem in the H4 to H1 approval process OR in starting work once H4 to H1 is approved because of the H4 extension filed previously and pending.

    My husband's attorney says it is not possible to withdraw my H4 application alone since it includes my son's name also as one of the H4 applicants. Please let me know if that is correct. Any option for us?

    My H4 was filed as normal processing on Sep 16 with H4 start date as Sep 27. My H1 employer filed H4 to H1 COS on Sep 24 in premium with start date as Oct 1. The COS is an amendment of the previously approved Consular Processing H1b petition. 1) Please let me know if I can start work in H1 immediately once H1 comes through and while H4 is pending. 2) Please let me know if it would be fine if I can ask for withdrawal of my H4 application after I get the H1 COS approval.

    Thanks for the response. Please see if the following option will work : Ask my husband's employer to upgrade his 7th year extension to premium. Once H4 also gets approved in premium, my H1 employer can do COS of new H4 to H1.
  18. My 2015 H1b application filed as consular processing has been selected in the lottery and currently under USCIS processing. I came to US a couple of days before Apr 1, 2014 on H4 to spend a few months with the intention of going back to home country in June. Now I am thinking of continuing stay in US on H4 until Sep and resume job on H1 from Oct onwards. Since my H1b application is selected and currently under processing, can I right away ask my employer to convert the CP application to COS from H4 to H1 OR should I wait until H1 CP application is first approved and then do a change of status from H4 to H1. Which of the two options 1) is cost-effective 2) has greater approval chance, please advise.
  19. Thanks . But I am thinking the visa stamping and travel fee put together is also equally expensive and the employer may in fact agree for filing a COS . Please share your thoughts.

    Travel before or after H1B

    Hi I have successfully got my H4 approved today and eager to travel soon. My H1B employer will be filing H1B petition for me this April. Please advise which of the following options should I follow: 1) In case I am able to get back the passport and book ticket in another 3 days , can I travel on H4 immediately ie. can I travel before Apr 1, say on 28/29/30/31 Mar OR 2) should I wait until my H1B petition is filed OR 3) should I wait until the H1B petition is approved.     Hi Jairichi Please clarify your answer to point 3. I was thinking the COS is just an additional step in the H1B petition approval process and will be less expensive when compared to whole H1B petition process. ie. when COS is applied after H1B approval is done, just I539 has to be filed with the COS fee which I believe is around 300 dollars. Please let me know if that is not correct.

    Thanks. In case I reach US in the weekend and my H1B employer files the petition on Apr 1 (Tue) : 1) Is it absolutely necessary that the petition should have been filed as a COS. 2) If 1 is NO, so do you say it is fine if my location in the petition was mentioned as India although I was in US at the time of filing. 3) Can COS be applied later after the petition gets approved say in July. I am not sure if the employer's attorney will be able to accommodate the last minute change in the Apr 1 application by making it a COS, hence seeking your advice.

    Travel to US on B2 or H4

    My L1A Individual is getting processed, but not sure when I will be going to US since the actual start date of the projects is not finalized yet. My husband works in US and has H1B petition approved,although not stamped. I have B2 visa. Can I travel to US now OR travel as soon as I know L1A Individual petition is approved on B2 and stay with my husband until the L1A projects start date. Then do a COS from B2 to L1A. Is it ok to travel on existing B2 or should I get a H4 visa for travel and then do a COS from H4 to L1A in US. Is it even possible to do B2 to L1A or H4 or L1A without leaving the US.

    Thanks jairichi If it is legal for the employer to do the H4 COS to L1A without the beneficiary leaving the US, is there any reason why the employer would ask to get the L1A stamping and re-enter.

    L1A Individual stamping

    Sir My husband and son are in US in H1 and H4 respectively. I am staying in India for past 15 months years taking the one-year break out of the country. My L1A Blanket got rejected recently and L1A Individual is currently getting processed. My US work location is going to be same as where my husband and son live. How do I handle a Visa officer question such as 'Where will you stay after going to US ?' . Also, will I be denied visa since VO will think I don't have strong ties in India as my husband and son are in US. Note, I am the only child and my parents live in India. We have properties in India as well. Please advise if I should voluntarily tell such details to the VO.
