  1. Hello, I am planning travel to India in the next week. As part of the travel, I plan on getting my h1b visa extension stamped. I have completed 6 years on the h1b, have an approved i-140 from previous employer, i-140 pending with current employer. I have approved I-797 for additional three years based off my approved 140 from previous employer. Is it advisable to travel for the visa extension stamping? Since the language in AC21 says "may" for 3 year extension vs "shall" for 1 year extension, what is the possibility of stamping being given for only 1 year even if you have an approved 797 for 3 additional years? I have a full time position with a reputed company. My extension is dropbox option, same position, same employer. Thank you for your feedback.

    HI DKHS, Honestly I even wonder if they bother to go over the resume at all..or they go ahead and just do some sort of a "back ground check". In my humble opinion..no matter what kind of "resume" they expect you to submit...they are going to take their own sweet time in processing the application. This whole resume business i think is more of an eyewash than anything. Total Humbug, trying to discourage people from going through the horrendous process of visa stamping... I understand your anxiety..as was the case with all of us..all the docs you submitted seem sufficient. Just be patient. S
  5. Hello All, Had interview at the US consulate, Toronto on Dec 13th. As many have posted on the forum, inspite of have MS degree from states and continously working in the same field as degree and having had H1b firt time stamping done in India, I thought it would be ok to come to Canada for renewal of the H1b visa and in the meantime also visit my friend whom i havent seen in 5 years. Alas, I was slapped with the 221g and now stuck here indefinately. I also have a trip planned to India in one week from US and now will have to cancel that too and lose money there. Plus took a rental car, which i cannot return and losing money there too. Plus hassles of work from home etc. Anyway after my lamenting about sorrows similar to all of you, here is my question. Since the timeline for this administrative processing is not specific, would it be advisible to just to to India from Canada and return to Canada based on when they ask to submit the passport? I have my passport with me with multiple entry visa to canada. Please advise. Thank you Sushmitha
  6. Hello all, Addressed to Murthy Law Firm, I am one among the many affected by the TAL 221g cases. (Having all genuine documents, applications, real jobs and working so hard at not being out of one, and striving to be in the same fields of education, plus paying taxes, rents, mortgages, educational loans- Seems like we are being taken for granted) The wait and reason for same seems too ridiculous. I am stranded here (Toronto) since Dec 13th and I see there are cases worse than mine. -Seems to be the norm around all embassies. This whole thing seems too dumb. Is there a way of placing a formal appeal or complaint through forum or law firm to the immigration department regarding the ridiculousness of this wait?? Was not sure if something of that nature has already been done? Upon checking on the USCIS website, it says that they are aware of this and are trying to streamline the process blah blah..but apparently they dont seem to be doing a sensible job of this! Please advice Forum. All your input in this regard is much appreciated. SR

    Subrven1 and saiBB: from what I have observed seems like 30 days is standard wait for FTE. Recommend you get in touch with the consulate once this period passes. Mine was similar case : FTE, 2nd time stamping, 30 day wait.

  10. Hello All, Finally got my visa: After the debacles of ice storms, power cuts, trip cancellations, monetery losses. Anyway here is my story. Dec 13th 2013: Visa interview at the Toronto Us consulate (Slapped with 221G- for H1 renewal) No updates on CEAC website Jan 7th 2014: Sent email to consulate requesting update Jan 10th: Recieved clearence email (asking to submit passport on a Tuesday or Thursday) Jan 14th: Submitted Passport (Requested lady at drop off window for early passport retrival explaining my 30+ days wait. She asked me to come pick up at the consulate Jan 16th- But no gurantees) Jan 16th: Picked up passport with stamp. (Fortunately..) Total waiting days : 35 including holidays. Thank you Murthy Forum for very essential information. 221g TAL checks: Unreasonable waits: Still think we need to formally file a petetion or appeal regarding this hassle. If i find information regarding this, will post here. Best Regards Please stay positive. A few pointers to all: Wait for 30 days before sending an email to the consulate. Also keep checking CEAC website (in my case it was a utter dud and still shows AP) but for few if you see a status update, I recommend you visit the consulate in person and enquire with the security or lady at the window regarding application status of your visa. If you have been waiting for more than 30 days and recieve a clearence email, do not hesitate to request for expedited passport collection. (This is specific to Toronto consulate) Thank you all.
