    Calling all Toronto 221Gs

    So, I finally got my passport and got back to the US. My timeline: Interview: 25th September. First Status Change: 16th October. Second Status Change: 15th November. Clearance email: 20th November. Passport mailed to consulate on Thursday 21st November. Status changed to issued on Friday 6th December. Passport received:11th December. Came back to the US: 12th December. Good luck with your repsective cases. The wait is extremely frustrating, but it gets done eventually. Preferably do not apply in Canada and especially in Toronto.

    Got clearance email yesterday afternoon. 56th Day of waiting. Will be mailing them my passport today. Summary: 25th September interview. (F1 visa renewal, I was on OPT status). 221G Yellow given. 1st Status update date 16th October. 2nd Status update date 15th November. Clearance email received 20th November.

    I really don't know if that number is accurate across all cases. It will be 56 days for me tomorrow and I have't heard from them. Congratulations to you though!!

    Did anyone get clearance so far. Justin9, chavvavijay? You guys had your interview ~25th september too right? My case updated date has changed to 15th November, no change in the status though.

    Kalyan, thanks for the update. Very thoughtful of you to update. Today is my 49th day. I'm hoping my approval comes through on/before the 50th day just like yours did! Wish you all the best in future endeavors.

  9. Hello, I had my F1 visa renewal interview in Toronto on the in September 2013. 221G status was given during this interview and I have been waiting for my case to clear since then. The problem is - I am on OPT. My OPT period began on at the end of August. I was supposed to graduate and join work on Sept 9th, that got delayed to Oct 21st and in the interim I had to travel to Toronto. I wanted to use this opportunity to get my visa renewed since I planned to travel to India in December and to and from Canada over the next year. Due to the 221G, I have been accruing unemployment days for no fault of mine i.e. I have a valid offer, I can join work if they let me in to the country by giving a visa. I am close to hitting the 90 calendar day mark. To avoid going out of status, I contacted the company I was supposed to join to ask them if they could employ me remotely. The immigration attorney consulting with this company said it didn't matter - I would still be unemployed even if they got me working remotely since I would be out of the country. And that my only hope was that the visa arrives in time before the 90 day period expires. If not, I'd have to wait till H1B gets stamped to enter - i.e. ~ another year at least. I tried looking at forums, read USCIS and SEVIS guidelines. The language is somewhat unclear. Here's what SEVIS has to say about this: Here is what USCIS had to say about this: Since the language is a little ambiguous, I was hoping if legal counsel present on this site could share their views on this topic. My questions are - If my employer in the US decides to employ me remotely - will I still accrue unemployment days? If I am employed with them and put on leave, does this still happen? Does the fact that I was employed once I stepped out of the country have any bearing on the validity of employment?

    I agree with this statement. They seem to be playing safe and routing decisions to DC. The VO didn't even bother to look at my case carefully. He asked me a few routine questions and gave me a 221G. OTOH, during my renewal last year in Calgary, the VO evaluated my profile, transcripts, resume very carefully, asked me in detail about my research, looked at the TAL (or I presume that is what she did) and then decided to give me the visa.

    This sounds highly suspect. Why would the shift the SAO process overseas? For reference: http://en.wikipedia.org/wiki/Security_Advisory_Opinion First off, an SAO gets processed in DC at the State Department and not at a consular office, because, to the best of my knowledge, consulates exist outside of the country, not within the country. Secondly, even if one were to believe this, why would something like that be shifted overseas? Wouldn't it make sense to shift it within the country since it is supposed to involve internal agencies?

    Doesn't one need a Canadian work visa to work in Canada? Even if you are working for a US company and being paid in the US in USD? I was told that for remote employment, I would need a Canadian work visa and if that takes too long, I might need to go to India before the 90 day OPT period lapses.

    Actually, I am still on OPT. Just graduated. Was going to join job in Sept, got delayed to October. Now the 90 unemployment days that one has per year on OPT are getting used up...that's why I'm a little tensed about the whole administrative processing thing. It's a chicken and egg problem - I have an offer and am willing to join and my company is willing to employ me. But the consulate wont give me a visa and then if the 90 days expire they'll say but you were unemployed for 90 days... Now, whose fault is that ?? :)
