Directly from USCIS website under FAQ section. https://www.uscis.gov/working-united-states/temporary-workers/faqs-employment-authorization-certain-h-4-dependent-spouses#_While_Waiting_for While Waiting for USCIS to Adjudicate Your Application for Employment Authorization (Form I-765) 1. Can I travel while my Form I-765 is pending? You may travel if you are in valid H-4 status and meet all the admission requirements, including having a valid H-4 nonimmigrant visa. However, traveling outside of the United States could cause delays in your case. While you are outside of the United States, we may need additional information to make a decision on your Form I-765 or we may issue a Notice of Intent to Deny (NOID) with an opportunity to respond. If you do not respond on time to a Request for Evidence (RFE) or to the NOID, we may deny your case as abandoned. Additionally, travel outside of the United States may also cause possible delays if we need to reschedule your appointment at an Application Support Center. Finally, please note that if you file Form I-765 concurrently with Form I-539 requesting a change to H-4 status from a different nonimmigrant classification, we will deny your Form I-539 as abandoned if you travel abroad while your Form I-539 is pending. In this case, we would also deny your Form I-765. If you choose to depart from the United States before your pending change of status application is approved, we will deny your Form I-539 and Form I-765, even if you are re-admitted as an H-4 nonimmigrant. In such cases, after being admitted into the United States as an H-4 nonimmigrant, you will need to a file a new Form I-765.

  3. I've recently applied for H4 +EAD. If I travel out of US while it is in-progress, would there be any negative impact like rejection of EAD or delay of the process ?

    H1B Extension Denied - Options

    Thank you for your suggestions. Just one more thing, is it advisable to go back to India and come with a visitor visa as soon as possible? For family constraint , don't want to be separate from them for long.
  5. Hello, My h1B extension is denied on 7/09. I applied for H4 (spouse is on H1B) On 7/12 I understand that denial means most likely I have to go back to India (home country), but since H4 is applied, can I continue to stay in US legally ? Thanks!
  6. Hi My visa stamping is valid till Sept 2017 and I797 till Feb 2018. This would typically mean I don't have to go for stamping if I visit India next week. However, visa is stamped in my expired passport and of course I have new & valid passport with me. I'll face this situation for the first time hence my question is - Do I have to go for stamping to make my new passport stamped ?
  7. Me and my spouse both are on H1B and spouse's GC is initiated. Once I140 is approved, can I apply for and receive EAD (being still on H1B) ? If No, what is the process for me to get EAD after my spouse's I140 is approved ? Thanks in advance.

  9. I recently change employer and have newly approved I797 valid till 2016. But my current visa stamping ends Sept 30 2014. I'm planning to visit India mid-Sept and would go for stamping as well. Also, I have to arrange for stamping on my own. All I need to know is, how to pay for Visa Fee in USD while I'm in US. Can it be done through any US bank or online (the way it is done in India, Axis bank or NEFT) ? Thanks
  10. Right now I'm in US. 1. My H1B stamping end date is 30 Sept 2014 2. Newly approved I-797 has date till Aug 2015 (due to change of employer) 3. Want to go to India in late Aug 2014 and back by 15 Sept 2014 4. Is it of any concern that I'll re-enter US just 15 days prior to stamping end date ? Thanks in advance
  11. 1. Previous H1B and I94 both were valid till Sept 2014 2. Transferred H1B to new employer. 3. H1 transfer approved with new validity till Aug 2015 4. Now if I go out of US for couple of weeks in Dec (to India), do I have to go for stamping ? I hope no. Pls confirm

  13. I'm planning to transfer my H1B to another employer. I also would like to transfer my spouse's H4 along with it. How much should be the expense for H4 transfer alone (if any)? I'm aware of H1B transfer fees though
