  1. I got my I-140 Approved & Priority Date is "Current". Though I'm on H1B, I am applying for Consular Processing I-824 for getting my Green Card Immigrant Visa number as I need to travel abroad immediately for personal reasons. Based on Consular Processing I'm supposed to attend the interview & do other procedures in my home country - India. It takes about 6-8 months for I-824 to be approved based on the current processing times. 1. During this interim period until my I-824 is approved, can I start some higher education in a different country and once approved then return to my home country for attending the consulate interview or should I strictly be in my home country until the whole process is complete ? 2. Once the I-824 is approved - during the interview will the immigration officer in the US consulate in my home country question me for starting education in a different country during this 8 months waiting period for my I-824 approval though I want to eventually relocate to US after getting my green card ? Your valuable guidance would be appreciated !!
  2. Dear Members, Requesting more information for my case. I have completed my Masters Degree (MS) in US & currently working as a Consultant in H1B Visa through an IT firm based in Florida. My Place of Birth is a Country in the Middle East/Gulf though my Citizenship is India. Would I be having the possibility of getting the Priority Date as Current or with low waiting periods when applying for PERM/Green Card through my Employer since my Country of Birth is in the Middle East/Gulf ? Would appreciate if you could provide information with this regards.

  4. Hello Members, Could you please help in providing the information on Priority Dates in the process of filing Green Card in Employer Based Category. Which of the below is the Priority Date ? 1. Date when I-140 is approved 2. Date when the PERM/Labor Certification is applied to DOL 3. Date when the PERM/Labor Certification is approved by DOL 4. If the Date does not fall on any of the above then at which stage is the Priority Date considered. I would appreciate if you could advise on this.

    To Apply for J2 Visa

    I am currently working in US with H1B Visa through a Consulting firm which is due to expire in 2 months. My spouse is in J1 Visa. Need your guidance/help in the below queries : 1. Can I apply for J2 (Dependant Visa) so that I can continue working once my H1B expires in two months from now ? 2. Do I need to Register my Marriage here in the US as part of the supporting documentation for applying J2 visa through my spouse who is holding J1 Visa & what is the process to do this ? 3. Other important Paperwork or Documents needed for applying J2 Visa in advance before my H1B expires ? Waiting for your valuable information for the above queries. Thanks !!

    Reg: H1 Transfer

    Thanks for this information. The reason I am not interested to share my Paystubs with the new Employer 'B' with whom I am planning to switch is because I have negotiated for a better Salary package based on a higher Salary that I quoted as being received from my previous Employer 'A' which is greater than the amount I actually receive. Is there anyway to disclose this Salary or Pay scale information from the new Employer 'B' ? Kindly advise me in this.

    Reg: H1 Transfer

    I am working for Company 'A' in US for the more than a year and would like to transfer to Company 'B'. Is it mandatory to provide the Paystubs which I received from Company 'A' and share that information to Company 'B' in order to process my H1B Transfer ? I am not that keen in sharing my Salary information to Company 'B' so if its really mandatory to give my Paystubs for processing then invariably Company 'B' would come to know these details. Please provide the requirements laid by USCIS/DOL for the H1B transfer processing with reference to the paystubs. Thanks !!
  11. Hello, I completed the DS160 form and have scheduled for a visa interview in Chennai in Dec'2013. I actually received an offer to switch to a different employer. Can you please tell me the process on how I could reschedule the visa interview. 1. Should I fill a new DS-160 with my new employer/petitioner details and pay the fees again ? 2. Temporary Work Visa - Name of the Employer : It is supposed to be the Employer (who filed H1B petition) to be filled here, please correct me if I am wrong ? - Where do you intend to work : I am working on a project with another client of my employer so Is it the end client location or my employer's office address to be given here ? 2. The Monthly Salary/ Income : Is it including the taxes (Federal, State etc) or the final amount that we receive in hand after all the tax deductions ? Thanks for your help !!

    Supporting Docs- Canada Visa

    Thanks Anil. 1. Can you please confirm if its "IMM5257-Schedule 1" which is different from the general application form "IMM 5257" as I already finished filling IMM5257. 2. Also as you said other than Original Passport rest all documents can be photocopy right ? Appreciate your response !!

Is IMM5257 Schedule 1 Form mandatory for candidates who are single and working in US or not required ? 2. Originals of I-797 Approval needed or would photocopy be fine ? Thanks !!
