    File FOIA over Email

I filed FOIA (G-639) to get the records that are with USCIS for my H1B petition 2 weeks ago. I did it over an email but have not yet received any kind of notification or confirmation of my application. Can anyone please share with me the timeframe that uscis takes to confirm the receipt of your application?

How to check if H1B Receipt Number belongs to me?

Doesn't the approval notice belongs to the employer? Will I be able to File FOIA (G-639) to get the copy of petition?
  3. I had filed H1B Visa through a consultant in 2008, the petition was approved, but I never got it stamped. I only have the H1 receipt number since the employer did not provide me with the copy of I797A. I recently checked the status online and found that the current status now is - Post Decision Activity We reopened this I129 PETITION FOR A NONIMMIGRANT WORKER on November 20, 2009, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations. Does this mean my petition was rejected? Can I still file under cap exempt category since the status is not showing as Approved anymore?
  4. I had filed H1B Visa through a consultant in 2008, the petition was approved, but I never got it stamped. I have the just receipt number and consultant is not providing the I797. I need to H1 under cap exempt category just with the receipt number. How do I confirm if the receipt number belongs to me? Is there any way to check if the receipt number I have does not belong to any one else?

He is not responding to my requests for I797A now. Can I file H1 under cap exempt category using just my receipt number? Can I take any legal action against the employer for not providing me with I797A?
