    Hi Thank you. My previous employer has been good with me so for. Since I just joined the new company , I understand he is trying to pull me back. Have little confusion. Since I haven't completed 6 years on my H1B , I cannot apply EAD for my wife even if the I-140 is in good condition ? Please let me know.

    Also one more question , I have not completed my 6 years period on my H1 but my I-140 is approved from previous employer. I believe I am eligible to apply for EAD even though I have not crossed 6 years as the I-140 already approved. Please confirm.

    I switched to the current employer very recently. Post this rule, my previous employer called and said he is going to revoke the I-140. Should he revoking the I-140 will prevent me from applying EAD for my wife ? Please let me know.

    My current employer gave me the I-140 receipt number. But he did not give me the I -140 approval notice. 1) With only the I-140 receipt number can I port the priority date with my new employer ? 2) With only the I-140 receipt number can I apply for future H1-B extensions with the new employer (if it is not revoked by the employer) ? Please let me know.

    Thank you. Does it mean that former employer can choose to revoke the I-140 ? There by new employer cannot use the former employers I-140 for future extensions . Please confirm. My Employer's Attorney said, Former employer can only cancel the I-140 and it has no effect for my future extensions using the former employers I-140. I will not be in the risk of running out of H1 extensions, so they are asking me to go through the company's policy of waiting period prior to starting the GC process. "Even if the employer withdraws your I-140 Petition, you should be able to use it for subsequent H-1B extensions if needed"

    Thank you MeghaD. As I understand, you had I-140 approved from Company A. Then you moved to company B stayed for an year (H1 extended for an year based on approved I-140 from company A). Then moved to company C (H1 extended for 3 years based on approved I-140 from company A) . But till then you have been working within your 6 years limit on H1 ? Your company A did not withdraw/cancel your I-140 as you have left them ? I came to know from the new employer's attorney, that there is cancel and revoke for I-140. Cancellation is the notice sent by Employer to USCIS to inform them that the employee no longer works with him and he wants to withdraw the I-140. Revoke is something USCIS does if they identify any document is a misrepresentation. Cancellation will not have any effect on the approved I-140 I am holding. Can someone comment on this.

    Hi My I-140 got approved recently. I am moving to a new employer now. The new employer has a policy in place that they will start the Labor only after 2 years. Since I got my I-140 approved does it mean that I am eligible for 3 year H1-B extension indefinitely, even if the I-140 is from a different employer (even if my old employer chooses to cancel the approved I-140). Or is there a timeline within which I need to get my I-140 approved from the new employer. Please let me know. Thanks.

    Hi I recently got my I-140 approved. At the same time I am getting a full time position with the client. Based on the president's proposal should I continue with my current employer for some time till wee see the effect take place ? If I take up the new position with the other employer now, will I lose the benefit from the president's executive action? Please help me to make a decision. Regards Raghu

    US stay period on H1

    Hi Thank you. When I am in US working on a L1 , my company filed an H1 in the year 2006 and go it approved. It had a validity from 2006 to 2009. I never got stamped nor Travelled on this H1. Will that be useful, to apply for H1 Cap exempt and travel again to US. Please let me know.

    Hi Here is my stay status, 4/8/2006 to 3/15/2007 - L1B 341 days (11 months 8 days) 3/31/2007 to 09/30/2009 - L1B 914 days (30 months) 10/1/2009 to 10/5/2010 - H1B (L1B to H1B transfer same employer) 369 days (12 months 5 days) 10/5/2010 to 1/18/2013 - Stayed in India 836 days (27 months 13 days) 1/19/2013 to till Data - H1B Cap Exempt I applied for H1 extension and got validity till 2/7/2016. Please let me know if my previous visit to US from 2006 to 2010 will be considered on my H1 ( close to 4.5 years) and I can stay only the remaining period ( close to 1.5 years) in US. Or As I stayed in H1 only for 1 year in my previous visit (remaining 3.5 years on L1B) , I can stay for the remainder of 5 years. My extended H1B has validity till Feb 2016. Please let me know.
