    EB1 EAD Vaidity

    Hi, Can anyone give urgent suggestion. My EB1 140 status changed to "Decision Notice Mailed" On May 1, 2019, we denied your Form I-140, Immigrant Petition for Alien Worker, We mailed you a decision notice that explains why we denied your case and your options. My attorney not received the physical notice notice yet. I want to know when our EAD is still valid for some time or it will be revoked automatically. As part of concurrent process, we got EAD and my wife is working on this EAD. I want to make sure, her EAD is valid and able to work legally, if not she has to inform to her employer and leave the Job. Kindly suggest ASAP. Regards,
  2. Hi, My employer applied for my EB1C concurrent filing of I 140 and I 485 in August 2018. Yesterday my I 140 status changed to "Notice Explaining USCIS Actions Was Mailed". I got the email update for my receipt. I am in tension. Can any one explain what could be the outcome of this action. There has been a recent processing action taken on your case.     I 140 status name was updated

    Hi , My EB1 I-140 status was updated as " Your name was updated on 03/21". What it means ? Can someone help me in understanding the action done in my case. What can I expect because of this action. Regards,
  4. My daughter got EAD as part of my EB1 Green card process when I filed for concurrent filing of I-140 and EAD pending I-140 approval.The EAD will expire in Oct 2019. Since she turned 21, she is studying on F1 visa from past 7 months and will complete under graduation in May 2009. Now she is applying for OPT. Can you please suggest, is there any issue in applying OPT, since she already has an EAD. Regards,
  5. Hi, I have applied for EB1 I-140 and 485 concurrently in Aug 2018. I have completed Bio metric on Oct 4th 2018 and the status changed "Finger print review completed". We got EAD card for all our family members in Oct 2018. I am still waiting for my I140 to be approved. When I saw the status today, i saw the following status. Can you please help me in understanding the status and what is the expectation after this status. As of February 9, 2019, we completed our review of your fingerprints and are working on your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number LINxxxxxxxxx1, at our Nebraska Service Center location.     Question on Green Card EAD extension

    Thank you very much.I understand that it is not mandatory to work at all on EAD as it is AOS. since her present status of stay in US is F1 visa, when we renew her EAD in October, is it required to change her status of stay to EAD ( I mean submitting EAD card in university, so they will consider the status, but she will loose her F1 status). Or is it OK her to continue on F1 visa and parallel we can renew EAD. Kindly clarify. Regards,

Since my daughter turned 21, she is studying on F1 visa from past 5 months. She didn't change her status to EAD as of now. The EAD will expire in Oct 2019. Before we apply for EAD renewal, is it required to change her status to EAD from F1 visa Or is it OK to renew her EAD without changing status to EAD. University student office suggested to continue on F1 until we get actual Green Card. Kindly suggest what we have to do to renew her EAD. Regards,
  8. MY Minor son's (Junior in High School) H4 VISA expired on Nov 11th 2018. We applied his H4 extension on July 17th 2018. Still waiting for the approval. As per Vermont visa processing timings, the H4 visa renewals priority date is in Sept 2017. Is there any issue for him to stay in US on receipt. Can any one suggest. Regards,

    EB1 EAD QUESTIONS

    Hi, Recently I applied for EB1 Green card process as concurrent filing for I-140, 485 AND 765. Today we got approval notice for I-765 for all of my family members. I have couple of questions to use EAD card in our employment. Could you please clarify. I put the detailed questions, please pardon me if they are many. Even though I got EAD now and valid through Oct 2019, Do I need to renew my H1B visa next year when it expires in August 2019. For me: Since I have H1B visa until August 2019, I hope it is not required to start working right now for me to work on EAD. Am I correct. I have to travel to overseas on Business try at the end of this month.I hope It should not have any issues since I have a valid H1B visa. My wife: She applied for H4 EAD in June, still didn't get it. Her existing EAD expires in Nov 2nd week 2018. Can she start working on this new EAD now. If she starts working on this EB1 EAD, are there any travel restrictions for her. She had valid H4 visa until 2019 Aug. My Daughter: She is now on F1 visa. Can we submit this EAD in college and convert her status to EAD immediately after getting the card. Do we need to take any precautions as She will complete her under graduation in April 2019 My Son: We applied H4 visa extension for my son in July 2018. Still waiting to get the approval. Now can I think, he can stay here on EAD even though there is a delay in getting H4 visa extension. Regards,
  10. HI, I have an approved I-140 with EB2 process having priority date in May 2011. Last month my company filed another I-140 application in EB1 category along with I-1485. I got receipt for I-485 and the priority date in AUG 2018. it was mentioned on the I-485 receipt as " Please note that if a priority date printed on this notice , for priority date does not reflect earlier retained priority dates". Can any one help me to understand this note. I didn't get receipt for my new I-140. It will go to my company and they didn't share with me. Regards,
  11. Hi, I applied GC on EB2 in 2011 and my I-140 Approved in 2012. Last month I applied to move to EB1 ( Multi national manager) and filed for I-140, I-485 and I-765 concurrently for all of my family members. I requested to consider my EB2 priority date which is in May 2011. I got receipts for I-485 and I-765. I didn't get receipt for I-140 as of now. Can some one suggest how long it will take to get my I-140 approved and I-485 approval. Shall I get receipt for I-140 . Regards,

  13. Hi, My daughter is crossing 21 in 2018 Nov. She is studying in US from 7th grade onwards and going to complete Undergraduate in April 2019. My Green card is in progress and I-140 approved in 2012. I am not sure whether my Green card date will be current before 2018 Nov. Is there any way to extend H4 visa to my daughter considering her long education in US and completion of undergraduate within few months of H4 expiry. Or Is there any way to request for EAD to her as a specific case. Please suggest. Thanks for your help. Regards, Venkat
  14. Hi, My EB2 Green card priority is in May 2011. My daughter is turning to 21 in Nov 2018. She is doing under graduation in US.If I don't get my priority date by that time, I have to convert her visa to F1 visa. My questions are: 1. If I have to convert her visa from H4 to F1, when I need to apply. 2. Even after converting to F1 visa, is she eligible to pay local fee in college as I am paying taxes in US. 2. If I get my priority date after Nov 2018, can My daughter get Green card along with me as a family member. If not what is the procedure. Could you please clarify. Regards, DV
