    Company Takeover - Filing for Two Employers

    Can the company that is going to takeover my current company file for an e3 petition with uscis while I continue to work with my current e3 under current employer? This is not a change in the real sense as the location, job, etc is the same. People have applied and got e3 for two different employers. Is my situation the same also? What can I do to avoid gap as there is no premium processing for e3?

    Your wife can be on whatever status she wants. However, not sure if her GC app will have any bearing on your ability to renew your e3, especially if you are included in the GC petition as a beneficiary. I know many people who got their GC on e3 status itself although some attorneys, including those at murthy, will not do it on e3 and ask you to change to H1. This is a grey area so technically they can't deny your e3 renewal, especially if you extend it with uscis. There is not much info out there for e3, so even attorneys may not be able to advise properly although you should still consult one.

  4. Would an attorney please advise: My current company is being taken over by another company in the future without a change in my job/duties or office location. My visa does not have premium processing (e3) and adjudication of application for change of employer with USCIS can take up to 6 months. Can I do the following to avoid gap in status: 1. File for a 2nd e3 with the "new" employer with USCIS and 2. Continue working for current employer 3. Will my 2nd e3 be valid only when I start working for new employer? Does it matter that I work for current employer even though a 2nd petition has been approved? 4. I know one person who works for 2 employers on this visa and obviously has 2 separate petitions approved. However, my case is slightly different because it is a takeover and technically the "new" job exists in the future from a particular date onwards. Will I be able to file a new petition with the new employer for the "new" job by providing a specific start date? How to avoid a gap? Thank you all.

    EB1 For Doctors in the Proposed Bill?

    "Visa number exemptions would also apply to the EB1 category and to certain physicians and PhD holders" Can Murthy firm please elaborate in Part 2 of its weekly Newsletter what the above means for M.D.'s who have completed their 3 year medical residency in an H1B or EAD category? Will M.D.'s who completed their 3 year residency be able to apply for a GC in the EB1 category also, if the new bill is passed? Does the PhD category include PhD's from outside the US also? Thank you.

The new bill that has been proposed (not yet law, long ways to go) has an interesting bit of info for doctors: "Exempt the following categories from the GC quota: EB-1 immigrants, doctoral degree holders, physicians who have completed the foreign residency requirement, and derivatives." Also, certain physicians. So does it mean that this bill will only be beneficial for those who finished a US residency program on a J1 visa???? How about those who finished their residency on a H1B or L2 EAD???? And what does "certain physicians" mean? Does it mean only certain specialties or something else? Would someone currently in final year residency be able to apply, if bill passes congress and signed by president? Can physicians expect to receive GC within 6 months like a lot of strong EB1 applicants do now? Hope Murthy firm can address this whenever they release their analysis of the bill. Usually, the doctors are tended to be ignored in the newsletters. Thank you.
