  4. I submitted my documents through dropbox last week and there is no change in status other than 'ready' (case opened). Passport is 'still with embassy.' Does anyone have any recent experiences in using Chennai dropbox (for H1, change of employer)? Please post on how long it took before you saw 'issued' for your visa status. Thanks
  5. I work as a faculty for a university, have approved EB2, I-140 and a PD not going to be current anytime soon. I have job offer from another university, they will sponsor H1b transfer, and work with me in getting I-140 (I pay expenses for GC). I would have started the 5th year of my H1b if/when I officially start to work with this new university in October of 2016. My question is whether I still have time to apply for (and hopefully receive) a new Labor and I-140 (will opt for premium processing) before it becomes June of 2018, if I start the process by March of 2017? Thanks

    latest on PD portability?

    Does anyone know of the latest USCIS trend on allowing EB2 employees to retain their priority date (from current I-140) when they move to a new employer who files for a new I-140? I am thinking of switching universities (am a faculty) and the only thing that is really worrying is loosing the PD. Any thoughts whether it is safe to switch now as I know current university may revoke my I140 when I leave them?
  7. I am currently a university faculty with approved EB2 I-140. I am taking job at a new university as a faculty. The lawyer for the new school asked me to submit a photo copy of the certified PERM (form ETA9809) from my current school. I have read cases here in the forum where people only had their I-140 receipt (from previous employer) to get a new EB2 approved when they changed employers. I asked the new school lawyer why he needs the current certified PERM to get me a new one? He says it is needed. Any thoughts? Please post Thanks
  8. Hello I am resigning from my current university job on May 18, and starting my new university job on May 19. Although I am on a 9 months contract at my current university, they pay over 12 months. That means, I will continue to be on current university pay roll as well when I join the new university on May 19 (and start on their pay roll). Would this be a problem to be on 2 pay roll for a few weeks/months although I am not working for 2 employers at the same time? There is a chance the current employer may cancel my H1b as soon as I leave them and may be just pay off the balance, but I cannot check with them about it yet (I am still waiting for my new job H1b to get approved). Please post your responses. Thanks.

    pay on temporary contract

    I currently work for a university and moving to take job at another university. Contract at current university ends on May 18 and that at the new university starts only on July 1st. However, to cover the gap from May 19 through June 30, the new school will request my H1b with them starts on May 19th and they will also put me on a temporary contract till June 30th. Should the pay for this temporary contract be above what is promised in their DOL application while petitioning for my H1b? Or, it doesn't really matter? Please advise.

  12. Hello I am currently working as a faculty in the Psychology Department of a university. I have a job offer from the School of Business in another University, with the title 'Assistant Professor in Management.' My specialization (Industrial/Organizational Psychology) is about applying psychology principles in workplace/organization. But the new job title is on 'Management'. My questions are: 1) Can such differing qualification and job titles create issues when applying for PERM or I-140 or say even in visa stamping interview (if I travel to India after getting a new H1b for new job here)? 2) I currently have EB2, I-140 approved through current employer. Anyone with experience of changing faculty position and have their previous I-140 revoked and loosing their PD? 3) My 6th year H1b will end in August 2018. If new employer starts the PERM in Sept of 2016, would that give me enough time to hopefully secure a new I-140 by August, 2018? Thanks

    Hello I work as a faculty with a university and currently on 4th year H1b. Have I-140 approved as well through current employer. Out contract is always annual and renewable, starting from August of a year and going till May of next year. But we are paid for the entire year, as they break the salary of 9 months into 12 months pay. I have a job offer from another university, also going to process my H1b premium and my GC. My question is the start date. As I have a PD, I am told that I should not have any gap in my H1b visas between 2 employers. If I do, then I loose my GC and PD. 1) So, for example, if my annual contract with current employer ends on May 18, but I am still paid for the summer, am I still an employee of current employer? I ask because I will continue to get paid for the summer as well. 2) Should I have the new employer get my new H1b start date as May 19? 3) If so, can I hold 2 H1b and work for two employers full time for a few weeks? 4) Will I be risking any law or putting my current I-140 at risk? Or, the new one that new employer will file for me?
  15. Thanks Rohang. As far as you know, would previous employers (particularly, universities) cancel I-140 if an employee leaves? How truthful is this news that I hear? Second, my 6th year is from 2015 through 2018, but say my new employer gets it up to 2019 (3 years from 2016) on the basis of approved I-140. Even if my old employer withdraws my I-140, I still get to have H1b up to 2019?

  17. Thanks for the reply. 1) I am currently on H1b extension through my current employer through June 2018. If the current employer revokes my I-140 when/if I leave them, I wouldn't get this 3 year H1b extension beyond what I currently have, correct? 2) Assuming current employer revokes I-140 when I leave them, and new employer starts my GC process of applying for a DOL in March of 2017, will I have enough time to get a new approved I-140 (premium processing) by June 2018?

  19. Hello I work in a U.S. university as a faculty. Today in day 2 of submitting my H1b extension docs through drop box in Chennai. I read different issues while using drop box, but find most such issues posted by non-academic applicants. Anyone working as a faculty who successfully used drop box for H1b extension? Please share your experiences. Chennai VFS collected all my passports (including old/expired ones). Is this common? Thanks
  20. I came to US on F1, did OPT and now on H1B at a U.S. university. Going to India for the first time after getting H1B approval last year. My university academic year is from August of a year through May of next year. I am going to India end of May and have to go to U.S. embassy then for visa stamping. Since my university issues the official yearly contract only every July, the Human Resources of my univ said they could give me a letter to VO, requesting I be granted H1B visa to re-enter U.S. to continue teaching from August 2013 on wards. My Dept. Head will also give a similar letter. Would this letter suffice instead of a contract? I have copies of I-29, original I797 and LCA, pay stubs, etc. Please provide your thoughts. Thank you

You are also right that my education, role and responsibilities can be easily verified through the letters that I will get from HR and my Dept. Head.     U.S. univ employee traveling to India for H1b

    Thank you for the response. I was told last week by another H1b employee that a signed contract letter between employer and employee is an important doc to produce at U.S. embassy in India when one goes for H1b stamping. As I mentioned in my earlier post, I wouldn't have this contract letter (when I go to embassy in end-May) for the future .....because our contracts are issued every July for one year at a time (from August through early May of next year). Any thoughts on this? Please post. Thank you

    Yes, it is called Lewis University, located about 30 miles out of Chicago. It was the HR that told me they could only give a letter stating that I need to come back to the U.S. to teach from August of 2013 on wards. Would this be enough? Any thoughts?
