    H1b Transfer without PayStub

    Hi Jairichi, Please help on my queries. History as under 10 March 2013 : Entered USA on H4 Visa 10 Sep 2013 : Joined College 13 Jan 2014 : COS to F1 from H4 12 Feb 2014 : Start CPT with Employer- A 01 April 2014 : H1b Filed by Employer-A 20 July 2014 : CPT over from Employer-A and Swicthed to Emploter-B on CPT 15 Oct 2014 : H1B approved for employer-A 16 Oct 2014 : Stopped CPT for employer-B 7th Nov 2014 : H1b Transfer initiated for Employer-C under premium processing. (No Paystubs from Empoyer A, but from employer-B) (Employer A has not yet revoked H1b petition) Questions: 1) What are the chances for H1b transfer approval? 2) If it approves will i get i94? 3) If no i94, what are the options available.     H1b transfer while in US

    Hi , I have a question regarding my wife. She entered US on H4 Visa in March 2013 Joined MS in Sep 2013 to be completed in Nov 2014 In Jan 2014 Status changes to F1 Febraury Started CPT with Employer A April 2014 Employer A Filed H1b and got selcted in lottery June 2014 CPT discontinued with employer A July 2014, CPT started with Employer B Now i am expected my H1b(from employer A) to be Approval soon, but Employer A says if they don't have JOB they would withdraw the petition. Now my question is 1) Can Employer B file cap exempt H1B petition 2) If Employer A withdraws petition once approved, Will I be Out of Status, from date from H1b is withdrwan to time new employer files H1b. Should i exit US on withdrawal date and come back on H4(can not come on F1 as its not stamped) Thanks,
  4. Hello All, I am also in similar situation and need urgent help. I am on F1 and joined a company in Feb 2014. They filed my H1b petition this year expecting their project will go for long. I made through H1B lottery this year and got the receipt number. But unfortunately company lost their client and now want to revoke the H1B. Can you please suggest the options for me: 1. If I ask the company to wait till it approved before revoke.. Does that mean my H1B case will be cap-exempt for next H1 filing by another employer? 2. Can I transfer my H1 before approval to another employer based on receipt number? Any other suggestions on my case will be really appreciated. I
  5. I joined a US compnany 'A', who filed my H1b transfer and started working for them from January 2013 onwards. They also made me sign a bond that, if i leave them within 1 year, I would need to pay them certain amount. They placed me at the client site and I started working over there. But over the time, I relealised that 1) I was not doing the work realted to my speciality occupation for which my H1b transfer was granted by USCIS It was all cooridation work thats not at all techincal. 2) We were made to work for more then 11 hours daily and sometime whole night as well. Working on weekends was like a culture at client site. and we were suppoed to notify that we are not available on any weekend. Even for daily work if we leave at 6pm, we were supposed to drop Leaving Early today emails. 3) Even after working for more than 60 hours every week, we were not allowed to fill Timesheet's for more then 40 hours a week. I discussed the matter with employer many time, but everytime they showed their inability and asked us to talk to Manager at client site. And keep promising to wait for a month and another and so on. All this resulted in immense mental pressure, disturbed work-life balanace and was pushing me away from my techincal expertise. It was above mentioned reason thats I decided to switch the job. So i started looking for the job and got an offer from Company B and joined them after resigning from company A. Now company A has hold back my salary for the month along with my leave encashment. At same time, they are asking for recovery of expense like 1) Airfare they born to fly me to USA 2) Medical Insurance premium 3) Hotel Accomodation they provided me for initial 15 days. Now my question are's 1) Is the recovery mentioned above legal. 2) Can they holdback my salary against the recovery amount. 3) Company A has not issued me the releiving/expereience letter. Is it legal. 4) Can company A create troubles with my future green card processing Thanks for your help.

    Incorrect VISA stamped

    Hello Saurabh, I appeared for H1b visa on 7th Jan along with my wife and son for H4 visa. My visa was approved and collected the passports on 10th Jan. For myself and wife Visa was correct. However to my surprise, VISA on my son passport was incorrect. they stamped B1/B2 instead of H4. I immediately checked with VFS and submitted the passport with all required documents for correction. However since then i have not update. Request to please suggest how much time visa correction takes and is there any way I can track the status. VFS guys says my son passport is with Embassy and they can not tell the time. Please help. Regards, Ashish

    H1B WITHDRAWL EFFECTS

    I am having a valid L1 Blanket visa from company x(approved in Jan 2012). Travelled to USA for 1 week in Jan2 012 and returned. Also same Company X also filed and H1b Petition approved on 5th Sep 2012, but NO visa stamping done. Now the assignment is cancelled and company is filing to withdraw the H1b petition. I am still working in INDIA with company X. My questions are Q1:- If some other company Y wants to sponsor H1b for me, is it allowed? Q2: Can I use the same receipt number and apply for Cap-Exempt H1b or or I need to wait for April 2013 for new quota. Q3: Do I need to wait until withdrawl is complete before making a new application Thanks Ashish
