    2 Audits in labor

    Hi, I had filed for labor in Sep 2012 and received audit in dec 2012. My employer replied to the audit in January 2013. In mid 2013, I got to know that my case went for BALCA. We receiving a docketing ticket in March-April 2014 in which my employer decided to withdraw the application so that we could file a new one. My employer then filed my second labour on April 24th 2014. I received audit on this 2nd labor as well (11/19). Below is the email that my employer sent me which states what is required for the audit: "They are asking for US Citizen resumes and recruitment summary before filing for the labor." My employer says that this is simple and straightforward as they have the documents already ready so will be responding to DOL in a weeks time and anticipating a quick turnaround. My question here is: Has this happened with anyone else as well and if yes how long would it take now and is there any chance of getting it approved. I am meanwhile getting ready to look for a full time position. Please advice!!

    I spoke with my employer and my attorney but they seem to say the same thing that there is nothing that can be done as it is a Random Audit and unfortunately i was picked for that . They suggested that they will file another Labor for me this April '2014. Is that advisable?

    PERM Exceptionally delayed

    I had sent my PERM application on Sep 26th 2012 , received audit in December 2012 and responded back to the audit on January 19th 2013. Since, then i have been waiting for my PERM response. Upon reaching out to my employer they respond saying that "Perm delays are pretty usual these days and almost 50% of the cases will get stuck in random audits. Once answered they sometimes get in to BALCA which is further administration and will not have any particular timeline." I do not know what BALCA is and what should be my next action. Should i just sit and wait or start over fresh again. My 1st H1 extension expires on December 31st 2014. Please suggest? Thank you Bhavneet

    I have been in the states for 7 years now and never stepped out of the country. My immigration status moved from F1 to H1 and currently on 1st H1 extension which holds good until feb 2014. I have also initiated my green card process and am waiting to hear after Perm audit . It's taken 1.5 years since I applied for perm and then replied for audit but still haven't heard back. Between all of this do you think it is fine if I get stamping done from Canada as I wish to travel back home. Do you think I could take the risk or chances are rare? Please advice

  7. I have applied for my Green card and awaiting to hear back the PERM audit. So during the filing for I140 I could add in my spouse as well right? He is currently in F1. So is it better if he files for H1 as well in April 2014. Im anticipating my labor response end of 2013 though?

    Investing in the US

    Hi! Is it true that if an individual makes a certain amount of investment in the US (Say gets Gas station or a franchise - subway etc). Does it contribute to getting some documentation and status. If yes, what is the amount that is required to be put in. Thanks Christa
