  5. Hello, My current H1B will expire in August this year. My employer has agreed to do premium processing for the H1B extension. I would like advice on the following: 1. Should I file for extension now in March? I am concerned that due to the corona virus situation even premium processing will be indefinitely delayed and I will be stuck in the US unable to travel abroad. 2. Should I wait it out and file in June/July when hopefully the coronavirus situation will simmer down? Employer has promised premium processing so I can still get the extension done and approved before August. 3. My passport has not expired but has only 2 unused pages. Should I apply for an H1B extension with this passport or get a new one? Suppose I get an extension approved and THEN apply for a new passport, and take the new passport for visa stamping in India, will there be a problem? Because then USCIS will only have information about my current passport and not the new one. Will that be a problem? Thank you so much for taking time to reply.

  9. Dear Forumites, I am on the 9th year running of H1B (expiring in Aug 2020) with EB2 category. My employer says I can't travel abroad for 8 months while the extension is happening. It is essential for me to have the flexibility to travel to India for personal reasons. What options do I have? Premium processing is suspended until Feb 19, 2020. What else can I do? Is Expedited processing possible? What would be a good way to convince my employer to shift to a faster processing option? How much does expedited processing cost? Please help if you can, Thank you!

    Visa extensions after 6th year

    Thank you Giri and Pontevecchio for your replies. I meant H1B (not I140), sorry about the confusion. I wanted to know if the visa would be extended until 2020 since the petition is valid until then. Also, what is the likelihood of another extension after 2020. I work full time at a university.

The visa stamping has expired and I need to travel to India for a renewal. My questions arise primarily due to the changes in H1B rules: 1. Is it likely that the visa will be extended to 2020 too? How will recent changes in H1B visa rules impact the extension of the visa? 2. I am planning to go to India only for 4 weeks. Is it possible that the visa will not be processed during this period?     Losing a job and green card

  14. In all likelihood I will be laid off my current job in Dec 2017. The job allows me to stay until May 2018 in my current position. However, I also have the option of resigning in Dec 2017 when the employers makes their final decision. My I-140 has a start date of Aug 2017. In Dec I would not have completed the 6 month period since the approval of the I-140. I still don't have a new job lined up. I am in academia and new jobs begin only in Sept of the academic year. So unless I can secure a new job (academic or non-academic) AFTER Feb 2018, essentially I lose the advantage of having the option of transferring the I-140 to the new position. Am I correct? What is my best option here in terms of safeguarding the green card process? Can I get the EAD in Feb 2018? If I quit my job after getting the EAD can I stay in the US jobless for a few weeks? May I also please add. If things come to such a stage that I have no recourse but to go back to India then is the entire green card process is scrapped and rendered useless? Suppose I were to get a job in future, say two years down the line, and my employer were to apply for an H1B and green card at that time, how will the termination of the current green card process get impacted? Will it have an adverse impact? Will it be harder to get a green card a second time? Thank you
