Yes, I do discuss, but as of now, am very happy with what he is paying. • Why is your salary fluctuating? Why there is deduction on paystubs? / Why so much change in salary? • Show me ur bank statements • Why is your pay less in last year W2? • Show me your W2 worked for your employer. • Show me your pay stubs • Where do you work at? • How do you like xxxxx place? • Do you have any issues/problems with your employer? • How do you get your work assignments? • Does your employer know about your projects? • Whom do you report to? What you will report to your employer? • How do you report to your employer? - Weekly status call, biweekly status report, stand-up calls when necessary • Who will allocate the work? XXX person from my company and XXX manager from client will co-ordinate and XXX person from my company will allocate the work. • Is there any gap (sitting idle) during change of the clients? / Are you on bench? / Does your company ever bench you? • I can see that your employer does not pay on time? No I get pay on time. (Please be more confident this time. Say it’s always on time) • Does your employer maintain employer-employee relationship? How? • How many employees does your employer have, and any one work in same location with you? • How your employer and Vendor are related? • Are you satisfied with all the companies you work or worked for? • Are you happy with your employer? CLIENT Questions: • From what time who have been working with your current client? • How long with client and employer? / Same time with employer and Client? • Do you have an end client? Do you have client letter? • Who is your End client? • What do they do? • How long you been working with your end client? / How many months you worked for this client? / How much duration you are working with Client? • Do you travel to client place? / Do you travel every week to client location? • What is your position with the client? • Where is your client located? • How far Client is from your place? • Do you work at a client site? • Any other employees working from your company at client? • What do you work at Client? / What is your work at client location? Explain same as in client letter • Do you have supervisor/manager at XXX client and what is his name? • How long is the project with your client VENDOR Questions: • Do you have vendor? / Do you have any layers? • What does your vendor do? • Do you have any one between your client and employer • How come your Vendor found your client? PER DIEM Questions: Why per diem is on your pay stub? (It does not count as salary. Your salary has to match or exceed the salary listed on the LCA) Why you didn’t have per diem earlier? Why it’s only starting from this year? Why you dint have per diem when project started? BACHELORS/F1 VISA Questions: • Where you did your bachelors? Is it technical? • Did you do your undergraduate in US? PIMS Note: Make sure that you Verify PIMS by sending an email to vancouverNIV@state.gov. PIMS (verifying the details of approved petitions through the Petition Information Management Service (PIMS) via the Consular Consolidated Database (CCD) Send this 1 week prior to your appointment to avoid 2-3 days of delay after your visa interview. You will not get any response from the consulate but it works. TO: PIMS@state.gov, vancouverNIV@state.gov Hi Sir/Madam, I am XXX bearing Indian passport: XXX, I have an appointment for visa stamping on XXX, I would like to verify my information in PIMS database. Please find the attached petition (I-797) and appointment confirmation for more details. XXX CLIENT QUESTIONS: In case consulate send an email to Client for further processing. You may prepare your answers and send them to your Client manager if he/she is okay with it to reply as you mention. Here are the list of questions: · Who (you/preferred vendor/petitioner) supervises the applicant, and is such supervision off-site or on-site? • Who does the applicant report to for work assignments? • Who completes the applicant’s progress reviews? Who reports to the Client Manager? How often Client manager being reported? · If the supervision is off-site and performed by the petitioner, how does the petitioner maintain such supervision i.e. weekly calls, reporting to the main office routinely, or site visits by the petitioner? Ans: Bi-weekly status reports and status calls as needed. · Who has the right to control the work of the applicant on a day-to-day basis if such control is required? Ans: Both. Applicant employerand Client · Who determines the direction of the project? Ans: Client · Who determines the applicant’s daily activities? Ans: Employer · Who provides the tools or instrumentalities for the applicant to perform the duties of employment? Ans: Both. Employer and Client · Who hires, pays, and has the ability to fire the applicant? Ans: Employer · Who claims the beneficiary for tax purposes? Ans: Employer · Who provides the beneficiary with employee benefits? Ans: Employer My Interview Experience Step 1: Appointment was at 9:30 AM. I went to consulate at 8:00 AM. They checked my DS-160 confirmation, passport and I-797 and asked me to come back at 8:30. Step 2: Went there at 8:30 and they checked my file and told me to remove the document from sealed envelope. Step 3: Security check on 2nd floor and again checked the file. Step 4: Submitted my DS-160, Passport and I-797 at counter 1. Waited there for around 15 mins until my number showed on screen. After that my number was showed on screen, took PP, DS-160 and I-797 from counter 1 and went to 20th floor where the actual interview was. Step 5: Waited there for around 15-20 mins. I was sitting right across the Visa Officer who interviewed me. Then my number came and my interview was like this. Me: Good morning sir, how are you? and gave him my passport, I-797 and DS-160 confirmation. VO: Didn't say anything. I put a big file with all the documents in front of him and opened it although he didn't ask for any document. VO: For how long you are working for this company? Me: 2 Years VO: So you work in XX? (My employer address) Me: No Sir, I work in YY(Client Address). VO: So you work for a Client? Me: Yes sir. VO: Who is your Client? Me: XXX VO: For how long you are working for your client? Me: 2 Years VO: You worked for ZZZ before? Me: Yes sir, I worked there for around 4 months when I was on OPT. VO: What do you do for your Client? Me: I am working as a XXX (Title) and told my responsibilities for about a min. All this time he was typing something in the computer. I was keep telling him my duties and he stopped me in between and told me okay, I understand. I am approving your Visa. Gave me one white form for Loomis information and told me you can track your application here and you will receive your passport in 3-5 business days. Me: Thank you very much Sir. Have a good one!! Thats it. None of the documents were asked. The interview was less than 2 mins. LITTLE TIP: Main thing I noticed is to have a smile on the face and answer clearly in whatever VO asks and BE CONFIDENT and Try to be as cool as possible. Trust in God. Carry as many documents as you can. Be confident while answering and answer them in a short sentence.   2. Hello, I am working for Employer A since 2010 when I was on OPT. My H1B started on 1Oct2011 and since then I am with employer A. I have my GC under process in EB2 category and my Priority date is Dec2013 and I have I-140 approved in June2015. I have my VISA, I797 and I94 until Sep2018 with employer A. I have been offered a Fulltime position at my current client. It is very good opportunity. I am not sure if I will accept the offer as I have concern regarding my visa status. My questions are below: 1. My 5th year of H1B is going on. My 6 year of H1B will be completed in Sep2017. If I move to employer B, how soon they need to apply for the Green card? Do my PERM and I-140 both need to be approved before completion of 6 years of H1B (Sep2017)? 2. What if the employer B apply for PERM after some time and it is still pending and my 6 years of H1B completed? Do I need to leave the country? 3. Can I apply for H1B renewal based on my previous I-140 approval? What if employer A revoke I140? 4. Employer B needs to apply for PERM and I-140 again. But can I use my previous priority date(Dec2013)in either case I140 revoke or not? 5. I recently got married and my wife is going for H4 stamping in few weeks based on my employer A petition. I am not thinking to join employer B until she come to US. After she come to US and if I join employer B, can I apply for her H4-EAD based on my I140 approval with emplyer A? 6. After joining employer B and H1B transfer, do I also need to do H4 transfer? If we leave the country, do we both need to do the stamping again? I appreciate your response. Thank you!
  3. I had my H1B Visa renewal in Tijuana, Mexico earlier this week and it has been approved. EVC model. The interview was very straight forward. No Documents were asked during the interview. I had my fist stamping in Vancouver in 2012 but looking at some of the recent experience that our friends in the forum shared, I decided to go to Tijuana. It is a decent hotel. Good thing about the hotel is it is only 5 mins walkable distance from ASC consulate. They also provide shuttle to the US consulate and airport. Had good wifi connection in the room. I could work remotely as well as stream videos online. It did get drop few times still it wasn't that bad. There is one Indian restaurant Tandoor just across the hotel opposite Volkswagen showroom. There is also a Subway on the other side and there are many other restaurants and small grocery stores nearby. I didn't have that much wait time for I-94 as mentioned in the previous post. Overall it was a very good experience. My suggestion: Specially for the contractors. Please make sure you submit your DS-160 properly and go through it and all the documents before you go for the interview and be prepared for any question they may ask regarding your profile. Always have smile on face and be confident. Go with the attitude they also need you as much as you need them. Good luck! Cheers

  5. Hello, My H1 extension is approved for 2 years but there is an issue in the extension start date. My current visa is expiring on 9/19/15. But the extension is starting from 10/1/15. In the application, the start date mentioned was 9/20/15. So its an error from USCIS. My concern is, I will be out of status for 11 days in current scenario. What do I need to do to fix this issue?     H1 Extension start date issue

    My attorney sent an email on Aug26 to USCIS to correct the extension start date and also requested to approve extension for 3 years instead of 2 and submitted all necessary documents. Today my attorney received an email from USCIS that they have corrected the extension start date to 9/20/15 and also approved the extension for 3 years. I am really pleased with this outcome.
  7. Hello, I changed a client on 23Mar15(181 days from expiration) and my current H1B Visa is expiring on 19Sep15. My employer had applied for H1B Extension and Amendment in the same application. USCIS received the extension/amendment application on 4May15 and notice date is 8May15. Its been almost 3 months but the application is still pending and no updates from USCIS. Can you please let me know how much is the regular processing time for H1B extension? I read in the forum that Premium processing was suspended for H1 extension for some time. Can I upgrade it to PP now? Also my employer told me that I can't book the VISA stamping until my extension is approved. I am planning to visit India in few months and thinking to do stamping in Canada/Mexico so want to make sure extension is approved in timely manner so I can book the visa stamping date and plan a trip to India. Expert, please advise.

  9. I upgraded the application to premium processing as I need to travel outside US in some time. USCIS received the application on 8/11/15 and got approval for 2 years on 8/25/15. Thank you all for your advise. Hopefully you will get the approval soon. Cheers!

  12. That option is always there. The consulate is not in my city. And I just want to get the stamping done before I go so I can enjoy vacation fully without thinking about the stamping.

    Hi All, I had site inspection from USCIS at client location on 13Nov14. First he aksed Driver's license and noted down the info and asked me below questions. What is your Title/ work Responsibility / annual salary / Minimum Hours I work per week / highest level of Education and when did I finish Masters / Any other Degree / Who supervises my work and his contact number / Then he asked me about the contract between employer and client / took my latest 2 Pay Stubs and in the end he came at my desk to see the physical work location and then left. Now my question is its been already 3 months since this site visit and my employer hasn't heard anything from them. How long usually they take for them to verify? The contract at current client is extended till Feb2016 but I am looking to change the client for better opportunities. My current VISA is valid till Sep2015. Is it advisable to change the client at this time with amendment or should I wait until my employer hear back from them? Please advise. I would appreciate your response on this matter. Thank you, NP

    USCIS Site Inspection

    Thank you Rahul for the response. I have been told by my employer immigration officer that it is advisable not to change client until USCIS verification is completed if the project is not ending. They might feel that something was fishy that's why I changed the project. If the project is ending then there is no other choice. But in this scenario, the project is still going on atleast for another year so I should not change it. I am little confused now and not sure if I should change it or not.
