I’m working for an employer since 2011 on H1B and having I140 approved. I never had any problem with the company payroll and all of sudden due to some financial issues within the firm, they are having trouble in running the payrolls. From a reliable source in the company, I just came to know that they filed bankruptcy two weeks ago. This is not 100% sure as I have not received any email or note from employer that they filed bankrupts. My last paycheck ran on Nov 4th. I was already planning to switch another firm (Employer B) and accepted the offer. Now Employer B was already in process of filing my H1b transfer request in premium on Dec 5th 2016 as my joining date with Employer B is on Dec 15th 2016. I already submitted all the required documentation for H1b transfer and they are in processing of filing. With this situation, 1. How am I affected if my employer files bankruptcy? Am I out of status right now? 2. Do I have time to change the employer, if my current H1B status affects – at least two to three weeks? Any information that you provide will be helpful to me. Hello All, Can anyone please shed some light on this? Employer A: 1. Having approved I140, applied H1b petition on May 2013 2. Received H1b petition approval from 10/2013 to 09/2016. 3. Applied H4 at the same time and received approval from 10/2013 to 09/2016. 4. Work location changed, so applied H1 amendment, received H1B approval from 04/2015 to 03/2018 Employer B: 1. Applied H1B transfer on May 2015, received approval from 07/2015 to 12/31/2017 2. Applied H4 along with H1b transfer, received approval from 07/2015 to 12/31/2017 (Attorney filed H4 along with H1B transfer). I did not join Employer B and continued to work for Employer A. I applied H4 EAD for my spouse on basis of my approved I140 and received approval till 12/31/2017. Now I just came to know that USCIS has revoked the approval of my H1B petition that was applied by Employer B on Jan 2016 as I did not join their firm. No issues with this revoke as my Employer A petition is still valid and I'm still having valid petition from Employer A (i.e., till 03/2018). I further checked USCIS website to verify the Employer B H1B petition: It says 'On January 28, 2016, we revoked the approval of your case'. H4 petition status still shows "On July 8, 2015, we approved your Form I-539, Application to Extend or Change Nonimmigrant Status" I know H4 petition is only tied to Primary and not to Employer but now my concern is that when Employer B revoked my H1, will that invalidated my spouse' H4 approved petition that was filed along with H1 transfer? Can someone shed some light on this, please? Thanks, Krish.

Hello givemevisa, Appreciate your information. I have one question - I heard that if the person has done Masters in USA then getting stamping is easy...is this correct? I'm having client letter too but have not done Master in USA....so I'm trying to get the information from other folks on this. Any information on this greatly appreciated. Thanks for your help!

Yes....But mine is H1B (initial review - RFE - Response Review - Decision)...I read some where that it is denied message..but hopefully it will not be the case. Lets hope for the best! I will keep you posted on my status. -
As per below forum http://www.**************.html That's the generic language of when a petition has been denied.

Mine is.... On December 19, 2012, the review of your I129, PETITION FOR A NONIMMIGRANT WORKER was completed. You will be notified of the decision by mail. Please check our website at www.uscis.gov for further updates on your case, including when the decision is mailed. If you have not received the decision within 14 days of the date above, please call customer service at 1-800-375-5283 for further assistance. If you move, please use our Change of Address online tool to update your case with your new address. I'm also waiting for others input on this...if anyone come across this situation. -

My friend's receipt date: 21st May (H1B regular processing COS from H4 at CSC)..still in "Initial Review" -
see response here from Attorney_10: It is highly unlikley the H1B petition will be approved if there is any material changes to the terms of the employment while the H1B petition is pending. The petition must be filed with a valid LCA. Generally, a new LCA cannot be submitted while the petition is pending. So you have valid H1b until Sep 2013 + recapture period for 7 months..that means you have untill April 2014? is that correct?
