  1. Hi all, I need some one's guidance. Here is the situation: Model : EC. I got H1b Visa in end of Jan,2014, after my case got reaffirmed. Initially US embassy sent case back to USCIS and finally in Jan ,2014 (After 2 yrs) I got Visa stamping done. I spend almost 2 yrs in India with same employer and same client. I was working remotely during these 2 yrs period. As my reaffirmed petition is expiring in May ,2014, I was issued visa upto May ,2014. , so basically I got visa on Jan ,2014 to May ,2014. Obviously my employer will file H1b extension , once I will be in USA. I am planning to enter in USA in first week of March,2014, so basically 2 months before my h1b visa expring. Will there any issue at Port of Entry which entering in USA? Do I need to take care of any specific thing? Please let me know. Thank You. Trivedi
  2. Hi All, Model : EC I am writing just for information/updates for readers who wants to go for H1b stamping. I can write whole book on my experience but trying to put in summary. It's story of struggle & finally successfull visa stamping. I was working on H1b visa for around 6 yrs. I came to India for vacation & went to H1b visa stamping in Nov -2011. In visa interview, consulate asked for all the documents which I had. I provided all the documents and after 2 1/2 months, I received rejection letter without passport stamping. After that my employer & I were continouslly following up with US embassy, DOS & USCIS. My case reached to USCIS in Sep-2012 ( almost after 8 months) and In dec-2012, my employer received RFE. My employer replied to RFE, In a week, USCIS reaffirmed case. I received reaffrimed petition in April -2013. It took another 3-4 months to go for second interview at US embassy. In Sep-2013, I attend second interview , again consulate put me on 221(g) and asked to submit employer related documents. I submitted those. After that consulate inquired to client side again. Client replied back to KCC. After that US consulate continously asked for various documents for almost 6 times. I submitted documents and finally today I received passport with Visa stamping. It's kind of long story but real. One common lesson I learned, If you are genuine & your employer, client is genuine than US embassy will give you visa but you, your employer & your client must support you all the time. I am sharing my experience because it's my moral responsiblity as this forum gave me lot. Thanks. Trivedi

    KCC's Contact Number for Client Verification.

  4. Hi All, I need urgent help from you guys. This is very urgent. My case is : EC (No middle vendor). I gave my H1b visa interview at New Delhi US embassy. After interview , they issued 221(g) for asking to submit documents. I submitted documents. After one week I received a phone call from the US embassy to submit additional documents. I submitted those documents as well. Now today , I received a call from the US Embassy again saying that my Client(NOT my employer) needs to contact Kentucky Consular Center (KCC) and until than my case will NOT process further and hold on 221(g). I received e-mail with same content. This must be client verification call from the US Embassy. Can some one have KCC's contact number?, so I can give it to my client. I already searched on google but the number which is given on KCC's web site is for Diversify lottery , NOT for Non-Immigration visa. If some one have the KCC's contact number. then reply to me on ASAP basis. It's very URGENT. Regards, Trivedi3377.

  7. Hi All, Let me explain you situation , so hope some body can help me. I gave H1b renewal interview at New Delhi Embassy. In interview, they asked standard questions. After end of the interview, they issued 221(g) and after 2 1/2 month, I received letter saying that they are sending case to USCIS for review. USCIS reviewed case, send RFE to my employer, my employer replied quickly and finally case is reaffirmed. USCIS send reaffirmed petition to my employer. I send Scanned copy of reaffirmed petition and immediately on next day, I received response saying that to come down for reinterview at the location where you applied earlier. It means in my case I applied to New Delhi earlier, so I have to go to New Delhi. Now my question is : Can I go to New Delhi for reinterview or Mumbai? The reason is that Mumbai is my home post. First time , I went to New delhi because on that time Mumbai embassy was closed due to renovation work. I knew that if i go to Mumbai then I have to file new application but that's fine. My point is that where is the maximum chance to get Visa? New Delhi or Mumbai? Means New Delhi embassy knew my case history and If I go to Mumbai this time , they will reinvent whole wheel again. This is my opinion and I may be wrong also. or Mumbai embassy knows my case history also?? I don't know answer. Can some body have answers/opinion/suggestions/share experience on this?     case Reaffirmed

    Hi All, I gave interview for H1b renewal in Nov, 2011 at New Delhi Embassy. Here are events of the my case: MODEL : EC(Employer - Client ). Product development company. Interview date : Nov,2011 - New Delhi embassy. 1. Case sent to USCIS : Feb 2012. 2. USCIS received case from the embassy : December 7,2012.(took almost 10 months). 3. USCIS sent NOIR to employer : March, 29th ,2013. 4. Employer sent all documents by : April 23rd, 2013. 5. USCIS reaffirmed case on : April 30th, 2013. I am hoping that my employer will receive I-797 in next few days. Now my questions are : 1. Can i re-appear second interview at Mumbai embassy as it's in my Zone?I can pay application fees again. First time , I went to New Delhi because mumbai embassy was closed. 2. Can some body tell me what should I do next? Regards, Trivedi3377.

My case went to USCIS for review and now my company's attorny received notice of Intend to revoke(NOIR). It's saying that my company is consulting(body shopping) company. Actually my company is NOT doing any consulting business. I am on E-C model and I am full time permanent employee since last 4 yrs. Company never hire employees on rate/hr business. It's product development company. Company is NOT having any middle vendor in any other projects as well. Can some one help me by giving suggestion , so we can prove that my employer is NOT consulting company. I can understand that it's my company's headache but indirectly it's my headache also. Pls. help me by giving your suggestion, so atleast we can give strong proof to USCIS. Thanks in advance. Regards. Trivedi

    @San, Contact USCIS first , to make sure what is exact status? I read some where that USCIS is making some times glitch in the system and sending randam NOIR.

    Hi all, I was on H1b visa , got h1b extension and my petition (I-797) till may - 2014, came to India for visa stamping. VO gave me 221(g) query and finally received letter saying that we are sending case to USCIS for review. Today I received email from USCIS as below" "On March 19, 2013, we mailed you a notice indicating we intend to revoke the decision made on your case. That notice will explain in detail what action we intend to take. Please read it carefully when you receive it. If you have not received the notice within 14 days of the date above." My question is that as I have valid petition(i-797) till May -2014, can I do H1b transfer with different employer using my petition which is valid till May -2014.? Regards, trivedi

    @Attorney_11, Let me ask you more refined question, so nobody get confused. After getting Notice of intend to Revoke(NOIR), can I use same Petition (I-797) which is valid till May -2014, to do H1b transfer with another employer? Obviously new employer will file H1b transfer by using this I-797. Can I do that? Please response. Thanks, Trivedi
