    RFE for H-4 EAD extension

    Hello, X has H-1 till April 2021, and Y(dependent of X) has H-4 till March 2020. Y has applied for H-4 EAD extension before applying for H-4 renewal(assuming H-1 is until April 2021). Now Y received RFE requesting more evidence. I assume H-4 needs to be renewed before we apply for H-4 EAD extension (or) can both H-4 and H-4 EAD be applied at same time. Please confirm. RFE is shown in attached image. Please advise. Thanks in advance!
  2. Hello, My employer has filed for H1B this year and got an RFE to provide client letter (Employer-Employee relationship). I'm currently working in EVC (Employer - Vendor - Client) model. Here the client is State Government firm. The client says they cannot provide letter on their letter head as it's against their policies. The employer says providing client letter would be strong case. I'm sure this is the case with all federal government agencies and though H1B still got approved working for them without having client letter. Please suggest what are the other alternatives for getting this H1B approved. I'm very worried. Please advise. Thanks in advance!

I got an RFE on 'Completion of a Bachelor's or Higher Degree in a Specific Specialty'. Please advise on: How to respond for this kind of query? What documents needs to be submitted?   4. Hi, I'm working for Employer A and currently on initial OPT set to expire on 02/04. Now applying for OPT STEM Extension. Now I changed to Employer B. Tentative start date with client would be 02/05. Is this ok? Or the new employment date has to be before 02/04? Also they're willing to change the start date accordingly. In I-983 form, for Start date of Employment field - what should be the date? 02/05 or preferably before 02/04? Thanks in Advance.
  5. I'm currently on OPT. Unfortunately I have to change my employer from A to B during H1B appeal. Note that A is not withdrawing the case. What are the circumstances/implications?
  6. Hi, I'm currently on OPT and was working for Employer A till Nov' 2018. Employer A applied for H1-B and got an RFE and its denied later on. But they appealed the case which is currently still under processing. Being said this, I've moved out of Employer A. But employer A informed that wouldn't be withdrawing the case and I can transfer it to other Employer. My start date with employer B is 2nd week of January. Here are my questions. Please suggest. Firstly, Is it ok to change to Employer B while the appeal is under processing? Or the appeal should be withdrawn by employer A inorder to join with Employer B? I'll be joining with Employer B on my OPT status. Would it be ok to do H1 transfer to Employer B later after the current is appeal is approved? At this point, if the H1 is approved, what would be the tentative H1 start date - From day of appeal approval date or Oct, 2018? And say if the H1 start date is Oct, 2018 - Would it be considered as an unemployment till date? If so, will it effect my status? Thanks,

Specialty Occupation Degree is Normally Minimum Requirement - USCIS mentioned wrong code number inspite of submitting LCA with the appropriate code number. Not sure if we can appeal here. Degree Common to the Industry Position So Complex or Unique Employer Normally Requires Degree or its Equivalent Nature of Specific Duties So Specialized and Complex Additional evidence you may wish to provide Worried a lot. Please respond.

    H1B visa transfer

    Hello, I have a valid H1B visa stamp with company A thru June 2017. Now I moved to company B and have a valid approved H1B document, but not visa stamp. The new H1B has a valid date till July 2018. In this scenario if I travel to India/Abroad in next 2-3 months, do I need to attend Visa interview for re-entry to US? or can I still enter to US with the current valid VISA stamp which has company name A on VISA. Please advise. Thank You for your replies!
  14. Hello, I have a H1 visa interview in Hyderabad in November. I just found that my name misspelled on VISA appointment. But name is correct in DS-160 & Passport. It's only wrong in VISA appointment letter. I'm so worried and no idea what to do? Can I still go to the appointment? or Should I cancel this appointment? Please advice me. Thanks for your advice!!
