  1. Hi Experts, My priority date of 5/15/09, EB2 from India has become current. What happens next. I have changed employment since you last RFE about work filed in 2016. My medical file is current. My EAD is valid till 2/2021.

    The New Bill Passed in USA

    No, not at all. What has been approved by the Senate Judiciary committee is discussion by the select committee to allow the Bill to move forward for full Senate discussion which will last till June, this year, If approved by the Senate (likely to happen), the bill goes to the House where Republicans hold the majority. The Bill is likely to face tough discussion, negotiations in the House and if it at all gets approved. So, just hope for the best.

    Can I cancel spouse's EAD/AP before divorce?

    Why would you want to do that? Let things take natural course, time is a big healer and no matter what your ex will be grateful to you if he/she stays in this country on her merit, so even if he/she leaves.
  6. First let the immigration bill pass both the houses of the Congress. With the type of new reports emanating from the House, it seems very unlikely anything meaningful will come out of this bill and that it is not likely to pass any time soon. Keep hoping that some meaningful action is taken by the Senate and the House and the bill becomes a law. My guess is the earliest, if anything is likely to happen will be at least end of this year.

    If the I-485 has been filed as your dependent and you have the EAD for him, then it will not be an issue. I am sure he has his social security # and driving license.

    No, getting DL based on EAD does not in anyway activate the EAD. State Transportation/Motor vehicle departments are separate from the Federal State Dept. and USCIS. I have used EAD and also H-1B extension depending on whichever had a longer validity period. I am currently in the H-1B extension having filed for 1-485 and have 2 yrs extended EAD till April 2015.

    I think you are worrying too much about I-485 being denied. It is a hypothetical situation that may not happen. So far, you do not have RFE, if you have not broken any law and all your paper work is in order, why should there be a problem?

    It will not hurt. You can write a small note that your marital status has changed since you filed your original 1-485.

    H1B Visa, University change question

    If you have a teaching assistantship or likely to get one at the new place, that can be a good reason to change university. If the tuition is lower at new place, that also can be a reason or if there are direct flights to your country from the new place.
