  1. Hi, My relative was recently stopped at the US port of entry at the airport, and questioned why she was gone from US for over 6 months (she was gone for approx. 6 months and two weeks). The immigration officer at the port of entry also questioned her intention to live in US as she usually comes to US every 5 months or so, stays in U.S for several weeks and leaves for her former home country. She was never questioned until now. This time, she was 1) questioned strictly at the port of entry, 2) warned about potential LPR status abandonment through judge decision 3) advised to have a re-entry permit in she's gone again for "extended period of time" (no specifics on timing), and finally 4) let into US with an admission stamp in her passport saying "ARC 6 months". I'd like to know: 1) Based on her experience at the port of entry, does this mean that her LPR status is already considered as "abandoned", even through she was let into US? Is there a way to know if any action was taken against her status? 2) Does she really need a re-entry permit if she intends to come back in 4 to 5 months? (she has to go back to home country after staying in US for 2 weeks to undergo a special medical treatment since she cannot afford these costs in US). 3) If she does need a re-entry permit, would the two year period (while the permit is valid) be part of continuous residency or does it stop the 5-year countdown to naturalization eligibility? 4) If her continuous residency is interrupted by the re-entry permit, does she need to start it over to be eligible for naturalization in 5 years?     Health Insurance

    Hi Everyone, Can someone help us find out the health insurance options available for a green card holder. This is about my Friend's mom. She has a green card through his son who is a citizen now. His mom is now staying in US. However her medicaid was denied by state of Wisconsin as she stayed in the US for less than 5 years. Can someone suggest us the options available for her now.   4. It is close to 7 months since we applied for my H1 Transfer in Premium processing I havent received any update on my case from USCIS. Immigration Attorney asked me to request Senator or Congressman to contact FBI to work on my case. Has anyone ever reached out to Senator or Congressman?
  5. hey thanks for your response vinodh. Did you check if we can send one more application to them while this one is in progress. We got the below response from USCIS today. Good Morning: All petitions or applications received by the U.S. Citizenship and Immigration Services (USCIS) are required to have routine security checks that are resulting in delays of the adjudication of petitions or applications. The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required security checks remain pending. Until the security checks have been completed, we cannot move forward on your case. These security checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the security checks are complete. Thank you and we apologize for the delay.     H1B extension processing in Vermont center

    My H1B transfer was filed in the last week of August 2014. Still no updates from USCIS. My lawyer got the below response from USCIS. USCIS Response to my lawyer. This was in November 2014. --------------------------------------------------------------------------------------- Our records indicate that your name check request is still pending with the FBI. The FBI processes millions of name check requests each year with each requiring thoughtful consideration. We know how important this information is to you; however, the FBI must also balance the need for national security in preparing the response to each of these requests. The FBIs homeland security mission requires that the name check process be primarily focused on an accurate and thorough result. While an exact date for completion of this review cannot be given, you may be assured that the results will be made available to us as quickly as possible. Your continued patience is appreciated.
  7. Hi, My new employer has applied for my H1 transfer with Premium Processing to his company in the last week of Aug 2014. It is over five months now I have not received any update from USCIS. Case Status still shows like below. Case Was Received and A Receipt Notice Was Emailed On August 28, 2014, we received your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EAC1423351452, and emailed you a receipt notice. It is being processed at our Vermont Service Center location. The notice describes how we will process your case. Please follow the instructions in the notice. If you move, go towww.uscis.gov/addresschange to give us your new mailing address. I started working with my new employer since September 2014. I asked my lawyer to talk to USCIS few months back, Below is the response we got from USCIS. Thank you, Maggie T. ISO1 Premium Processing Unit VSC When I searched online I found that FBI name check process usually completes within days. Looks like my case was treated as an exception and taking more time even though we applied for Premium Processing. Has anyone ever had this type of issue with H1B Transfer or extension? My driver's license has expired and DPS is not renewing my license as I do not hold a valid VISA. Can someone tell me what steps I can take now? I think I have waited enough for USCIS.     H1B Education Qualifications

    Hi, One of my friends has a Bachelors degree and 3.5 years of work experience.His company is ready to file his H1-B this year.However, H1-B requires 16 years of education.Is it possible that 3 years of work experience gets accounted to 1 year of degree equivalent? Can the company still go ahead and file H1 with a bachelors degree and 3.5 years work ex? ANy help is gretaly appreciated.

For which I need to submit the Supporting documents. http://www.ukba.homeoffice.gov.uk/sitecontent/documents/out-of-country/visitors.pdf The above pdf lists out many documents such as Evidence of your current employment or studies,Bank statements or bank books, Payslips etc.Do I really need to turn in all these documents for a Direct Airside Transit Visa? Can someone help me listing out the required documents? 1. Passport 2. H1B 3. Photograph 4. Evidence of current employment 5. Completed visa application form 6. itinerary Did I miss something here? Also they are asking for Original or Certified Copies of these documents. What did they mean by certified copies. It is just attesting with the Notary Public? Thanks,
