    H1B Visa Extension WITHOUT Stamping!

    You do not need to get your Visa stamped for extension. The only time you will be required to get your visa stamped is if you leave the country. In that case you will need to get your visa stamped on your passport to be able to reenter the US. If you are in the US itself, you can apply for visa renewal without being concerned about the stamping.

    Missing middle name on I797

    I do not believe it should be a major issue. I personally know of cases where the First and Last names were switched. And it did not cause any issues at the consulate. The middle name seems to be a minor issue as compared to that. The Very Best of Luck to you for your stamping. Regards.
  3. Hi, I had to renew my DL as it was expiring on Jan 10, 2016. I live in WI and went to one of the DMVs in Madison. It was a fairly painless process over there. I went in there with the following docs: H1B Renewal Petition - Original Copy I-94 (latest copy) Passport I - 797 I am not sure about other states but in WI, when they process this particular scenario, after entering all the information in their system, they have to email another location to verify if the information is correct, and they have to receive a reply back. This does not take a long time though (5-10 minutes). Once they receive a reply, that's it. You are done. I received the extension that day itself. The actual DL being mailed via normal mail of course. I read in another thread that WI DMV does not issue extension to your DL if you don't have a renewed H1B, I-797. This is NOT correct. WI definitely processes and gives extension to people in our situation. Hope this helps.

    Can spouse travel on a B1/B2 visa?

    Hi Rana, I have the same issue right now. I have an H1B and my wife has an B1 visa. She has previously visited the US on official trips, twice within the last year. I was hoping that she could come and visit me later this year during the holiday season. I was wondering what did you do in your case? Did your wife visit you and did you face any challenges pertaining to her visit? Any help in this regard would be much appreciated. Thanks, Kanishk

    Many Many Congratulations Visablue. I am genuinely glad that at least some of us have a happy ending to this horrific ride. I am not sure if I should even hope the same for my self since after my case being sent back to the USCIS, my visa itself expired. So there is nothing left to do in that regard for me. But still....not all of us have to have that result. Congrats again bro. :-)

    Dude, I say as long as it is under admin processing and not "sent back" to the USCIS for re-eval its fine. I mean what happens if the visa expires itself, that too after such a long wait. Then its all over. These folks are willing to give amnesty to illegals but not have any flexibility or leniency for us.

Well i think visablues's case is different than mine....cause mine got sent back 2 the USCIS in March itself...visablues is stuck in "admin processing"....which as u know comes before the case being sent back 2 the USCIS. I am still waiting for the USCIS to give me the result of their "review". If they reaffirm my case i'll get nother appointment with the consulate and see where that goes....if not them my employer says they will fight the NOIR. Lets hope it doesn't come to that. Either way, I'll keep looking for ways to get my life back on track. Preferably in the US, and since i have been here for the past 9 months, i have taken up a job here itself. But my efforts regarding my H1B continue. I guess we shud all pray that once the elections are over and the DoS gets reshuffled, the incoming officials have mercy on our collective souls and relax these horrible and unjustified practices of the consulates.

    What about the USCIS Status check for your petition. The one that states: Post Decision Activity On March 7, 2012, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations." This site still shows me the same thing even after the 20th July "refusal" status update on the DoS site. How does this tie in to the DoS site update. Is anyone checking that link too..??     Lifting the ban on HR3012

    Oh great...as if we didn't have enough to worry about. This will mostly be used to harass honest and legitimate H1B cases like so so many others on this and numerous other forums. 221(g) was supposed to be used for only "certain" cases. And look where that has landed us. I wonder if they will ever realize that they are actually causing so much misery to people like us by their absurd actions. I don't understand their dislike for high skilled individuals who will actually bring in tax $$ to the US economy.

    Wow, I wish I had that VO. Sometimes I think its all about luck and not at all about the documents you carry or how legitimate your petition is.
  21. Hi, The exact same situation has happened to me too. My interview was on 3rd Jan 2012 in New Delhi, EVC model, got 221(g), submitted docs on 5th Jan and after that they did whatever the heck they do as a part of their investigation. So on 22nd March I got an email from VFS that my case has been sent back to USCIS for reaffirmation. Interestingly when I checked the USCIS link, it mentioned that they had received a request from the State Deptt. on the 7th March itself for reviewing the case. So now, I believe what is happening is that USCIS will conduct their own investigation into our cases. What they do as a part of that I have no idea, but I believe they go through the docs and stuff to ascertain the legitimacy of our petition. I have also found through my research that when the State Deptt. sends a case back to the USCIS for reaffirmation, they attach specific reason(s) for why they are requesting a review of a case. So depending on that, the review might be a long one or a very long one. Sorry to break this news to you buddy....but all of us are going through the same darn agony. Perhaps you'll b luckier. FYI: I was also a 1st time stamper.....and please do share any development that might happen @ ur end....cause i need to know how long this might take. And I also wanted to know how have to occupied urself during this time. I just want to know what are other folks doing that are in my situation. You seem to be the closest version of my case. Please do share, if you want to take this off-forum lemme know and I send u my email id. Thanks Hoping for the best for us all.

My case particulars: Model: EVC Consulate: New Delhi Date of interview: 3 Jan 2012 Got 221(g) Green Date of Doc submission: 5 Jan 2012 Since then i was in constant touch with the vendor and the client in terms of their interaction with the the KCC. Today I got the dreaded email from the VFS stating: As per the US Embassy your case has been returned to the Kentucky Consular Center in the United States. You may contact the USCIS office for further information. Please consider this case closed at their office. Interestingly a similar case had happened with another employee at my firm, his case was re-affirmed by the USCIS, but he didn't want to go back anymore as 6 months had already passed. The thing is that my VISA will expire in Jan 2013, so I am very much concerned about that. Also what really ticks me off is that the VO during the interview didn't ask of any documents from me, not one piece of paper supporting my petition. As soon as he came to know mine is an EVC model, he handed me the God forsaken Green slip. There is a blanket policy of handing out 221(g)s thats for sure. Unless you come across a VO in particularly good mood. It seems like this entire process is designed to destroy the dreams and aspirations of unfortunate individuals like us. I hope someone rectifies this brutal process sooner than later. So currently I am waiting for a reaffirmation. I really wanted to know what are all the other folks doing during the intervening period. Are you guys thinking about looking for temp opportunities here itself ??
