  1. Hi All, I am trying to apply for a visitor's visa for my mother in-law. They will be self-sponsoring the visa. My father in-law has business joint accounts with his friends. Will these be enough? Because he doesn't have liquid cash in his personal account, eventhough he has very good immovable property and couple of FDs. Can my mother in-law use my father in-law's joint accounts to show enough liquid cash? She doesn't have any in her name since she's a housewife.
  2. Hi, I am in a situation where my employer is willing to apply for the GC, but I am lacking a bit of experience. The fact is that I have been working since April 2010 till date, but I was stuck with my H-1B stamping in India for almost an year, during which I wasn't working. I have a Master's degree from the US, with 2.5 yrs of working experience. Per my lawyer, I need 3 yrs of experience for EB2 ,AND the 1 year I was in India does not count, is that true? So, should I wait for 6 more months to file it in EB2? or Just file for the EB3 and later can transfer it to the EB2 category (actually wondering if that is even possible?). Please advise.

    Travelling after 1 year

    I am travelling to USA after 1 year. My H-1B visa was stamped recently after being in admin processing for 11 months. What documents do I need to carry with me apart from my I797 to show at the PoE? Do I need an updated employment verification letter? Please advise.

    Guys, Let me tell you one thing. Don't try to be statistical here. It doesn't matter when was your PA or something. Its all based on your luck. When the almighty decides to give you the visa, it looks like everything is falling in place. Well, one thing what we can do from our side is try to keep pressure on the consulate guys, one way or the other. And the strongest would be from your company's side. A month before my visa was issued, my company's attorney contacted the consulate and presented to them that the company really needs me and the delay from the consulate to issue me a visa is really hurting them and they are not able to find a replacement for me. Although the consulate's reply was again generic, they also said that " we would try to reach a conclusion ASAP", which was definitely a strong statement. Getting visa after such a long time was a dream come true. and that too without losing my job. One more thing is that never give up hope on almighty. He is there to help you and he knows the perfect time, when. All the best for you guys and I will pray and hope that you guys get your visas soon. I actually wanted to post my whole experience in this forum, but due to lack of time, I wasn't able to. I will post it later when I have time Inshallah.

    Thank you brothers. Yeah definitely i will remember everybody in dua. Just have patience and trust in Allah and everything will be fine. You guys will get your visa soon inshallah. Well, my boss has asked me to show up ASAP. Actually, he wanted me to be in the office this monday, but its very hard to make plans this early. Inshallah I will be there by the end of this month.

  10. @omshiv, Forget USA? I really dont mind it, but why would they keep my case pending when they really want to reject it, that too for this long. Anyhow, I am right now working remote from India, but that is not satisfactory for me. I want to work during the daytime, kinda fedup with night job.
  11. Hi, I attended the H-1B visa interview at the Chennai consulate on Jan 27 2012. I received 221(g) pink form with no additional documents requested. I do have a common Muslim name. My passport is with the Chennai consulate. My case has been pending for almost 11 months now. Since the day of my interview, there has been no updates from the consulate. I tried every possible thing, like contacting the senator, congressman but always got the same generic reply from the consulate. Well, now my question is whether it is worth waiting for this? I am in an EC model and they did not find anything wrong with my employer (at least, not yet) which means that there is no need to go for another stamping with a change in employer. Does the pink form has an expiry? because I heard from one of my friends that the 221(g) has a validity for 1 year. If yes, then what after 1 year? I am kinda confused because I don't know whether to wait because I still have my job available. Its just a matter of getting my visa stamped. But at the same time, I dont know how long this is going to take. I am very confused. Please advise.

My passport is with the Chennai consulate.My case has been pending for almost 9 months now. At the time of the interview, the VO said your visa is approved, but you just need to go through additional administrative processing. And she held my passport. I do have a common Muslim name. Since then, there has been no reply from the consulate. They have kept me in the dark all this while. Any inquiries into my case only gave me the standard and generic replies saying, my case is pending admin processing. So, now since my case is pending close to 1 year, can I file a writ petition of Mandamus against the DoS or Chennai consulate?? If yes, can anybody let me know the procedure?
