  1. Hi Folks, I am about to invite my in laws for visiting us and planning to send them for Visa this month. But i am in the middle of changing the employer and so is my H1. Do you think i should use my current employer and send the supporting documentation or wait till the everything is finished. But the thing if i proceed now then by the time the interview is over there may be a chance that i may not be with the current employer? can you please suggest your valuable advises.
  2. 1. I know that my H1 can be transferred now. But if USCIS comes up with rejection after 221g, can i be able to go for H1Transfer ?? out of knowledge ,H1 Transfer has nothing to do with your old petition. 2. Do i have an option of going to chennai consulate other than hyd , once after getting my new H1 with EC model?? Yes. You can go to Chennai. Inform the filing company to choose Chennai consulate for consular processing at the time of petition. Good Luck.

Need advise on Planning to change from EVC to EC .

I attended visa interview ( EVC Model) at Hyderabad consulate on february 2nd, 2012 and my visa was rejected on the pretext of E-E criteria not being met.The case was sent back to USCIS for review. The USCIS has received the case on March 22,2012 but has not finished the review yet.It had been almost 3 months and i am loosing hope on it. I am now planning to proceed with EC model . Could you all please advise me if this model has higher chances? what type of questions to expect from VO ? All your responses are appreciated.

  7. Hi All, My visa was rejected on the pretext of the Employee and Employer relationship not being maintained at Hyderabad Consulate and petition sent back to USCIS. I have been reading the forum that the average time taken by the USCIS to review the petition will be any where around 2 to 4 months. what do you suggest in the following options to avoid the delay? 1) File amendment process (have been with the same client and vendor for the past 1.5 years, but vendor name has changed recently) 2) File new H1B with the same Desi employer? 3) File new H1B with prime vendor? ( EC) Appreciate the response.

H1B Visa interview at Hyderabad consulate (EVC)

Hi, I am on EVC. I have got the my H1 approved with my current project itself. I have been working for the same client for the last 1.5 year. I have answered all the questions , the VO seem to be convinced with my answers and everything. But he said that when the petition case was presented , reporting details were not provided to USCIS and said, we will send these details(reporting details) to them. If they are ok , then we will issue the visa or if they need more details they will reach out to your employer/you. Not sure how long this would take. is there anyone in the same situation?
  9. Hi , I attended my visa interview on February 2nd 2012 at Hyderabad consulate. The VO asked details about my education(Masters) and then went on asking about the client and then asked questions about the Employee employer relationship. At the end of it, he gave my passport back and said that he would present the case to USCIS and wait for the response from USCIS. I was not given any 221g or anything. All i was given was the summary of the interview(Memo) which will be sent to USCIS. When i asked about how much time will it take for the process, he was not sure about the timeline but gave a hint that would take about a week or so. Is there anybody in the same situation? please let me know . Thanks, shashi
