    L1-H1 Clock Reset & cooling period

    L1-H1 Clock Reset : I came back to India on 30-Jan-2013 from USA as my L1 visa was expired. Presently I am staying in India. Now My H1B has been approved and I want to go to USA. But (1) I would like to complete 1 year of cooling period in India sothat my old stay record will not be considered in future and I can stay for continuous duration of 6 years (including H1 extension after 3 years) (Happy Scenario). Is this True ? (2) If yes, then how 1 year period should be calculated? For Ex. my USA move out date was 30-Jan-2013 then new USA move-in date would be either H1 Stamp Date or new I-94 date (i.e. the day when I’ll reach to USA)? Please suggest. (3) I also heard that if you apply through fresh H1 quota then this calculation of 1 year is not applied. Whenever I’ll reach to USA, I’ll be eligible to stay for continuous duration of 6 years (including H1 extension after 3 years) (Happy Scenario). (4) Can I transfer my H1B visa to another employer when I am staying in India ? Thank You.

    L1 H1 Clock Reset

    Dear Sir, Can you please suggest me on below questions? Background: I came to USA on L1B visa on 1-Sep-2009. My L1B visa & I-94 were expired on 25-Aug-2012. I already applied for L1B Extension on 10-Aug-2012. I received denial notice of L1B Extension on 26-Jan-2013. I left USA immediately on 30-Jan-2013 and returned to India. I applied for H1B visa in April 2013 through H1B cap from India. I received Approval notice of H1B visa on 11-Nov-2013. Questions: 1) I would like to go to USA on 1-Feb-2014 sothat I could stay in India (i.e. outside USA) for the entire duration of 1 year. In this way, my old stay record will not be considered in future and I can stay for continuous duration of 6 years (including H1 extension after 3 years) (Happy Scenario). (h1B Clock reset) Is this True ? 2) If above sentence is True then What should be considered as baseline date for calculating stay of 1 year ? i.e. USA move-out date was 30-Jan-2013 and new USA move-in date should be either H1 Stamp Date or new I-94 date (i.e. the day when I’ll reach to USA) 3) I also heard that if you apply through fresh H1 quota then this calculation of 1 year is not applied.     wrong name in H1 application

    Dear Sir/Madam, I have applied for H1B in last week and received the receipt number also. But I observed that the Beneficiary name i.e my name is printed wrongly there. The printed name is Patil, Sanjay Kumar while my name is Patil, Sanjay Satish. Here Satish is my middle name. Can you please tell me whether this wrong name will be having any impact on my H1 processing ? and how & when to correct it ? Thanks, Sanjay

    L1B extension and New H1B application

    I am in USA working on L1B visa with employer X. My visa (and I-94 also) is going to be expire on 31st August 2012. My present employer X will be applying for my L1B extension on 1st July 2012. I am also having another job offer from employer Y and he already applied for my H1B visa in last week. Now my plan is – I am going to join employer Y on 1st Oct. 2012 ( the date from H1b starts). Is it Ok ? Is this legally right? Can I stay in USA for the month of September 2012 as my visa & I-94 expired on 31st August 2012. As per my understanding, I can stay in USA even after my visa & I-94 expiration as I have applied for L1B visa extension & its decision is pending. Please correct me if I am wrong. Is it ok if I can stay in USA for the month of Sep-2012 on the basis of L1B visa extension request and then joining another employer Y on 1st Oct 2012 ? Is this legally right? Please suggest . Thanks

    L1 extension & new H1 application

    Background : I am working in Indian IT MNC and Presently I am deputed in USA on L1B visa. This L1B visa is going to be expire on 31st August 2012. My present employer is going to apply for my L1B extension somewhere in 1stweek of August 2012. I am also in touch with another different employer who is ready to file my H1 visa on 1st June 2012. Question : The L1B extension application form has one column like “List any/all other filings filed on your behalf and currently pending at present” where the expected answer is Yes or No. Here the problem starts. If I say YES then I need to give my H1 application details and in that case my present employer will come to know that I already applied for H1 and he will not like it and he will ask me to go back to India. In short, there are chances that I can lose my present job. If I mention NO in this application form, then it is not good with USCIS because USCIS can easily track all my pending visa applications easily and they will not like it as I have given a FALSE information to them. In this case, I feel that, it might have some negative impacts on my L1 extension or H1 application. (pl. correct me if I am wrong) You are requested to please guide me in this situation. Even if I get H1 visa before L1 extension process, I can start my new job only from 1st Oct. 2012 whereas my I-94 & present L1 visa expires on 31st August 2012. In this case,I can stay in USA only if my L1 extension is in progress. In this way, I can stay in USA during September month based on this L1 extension case and then from 1st Oct, I can start new job on H1. Please correct me if I am thinking in wrong direction.
