H1B - I797, I94 and I-129 original Issue - URGENT
Chitown01 replied to KV2004's topic in H1B : General
Mostly everyone goes with Original I-797 and copies of I-129 because original I-129 is submitted to USCIS. As i said explain the employer that you need the notice for stamping and you will return it once u are back..... VFS just needs a copy of I-797 because they will verify your approved petition thru PIMS so all they need is a number from the photocopy.... Expalin to your employer and talk to attorneys -

I-797 C is the Receipt and NOT approval notice Your Attorney should have received I-797 A and there will I-94 attached on the lower section, if you received I-797 B, then there will be NO I-94 and you will have to leave the country get stamping done and re-enter.... When was your petition approved?

You can go for H4 stamping anytime... you dont have to resign and alll Once u re-enter us on h4, you CANNOT work with new employer He has to file a new petition with Change of Status, get approval with new I-94 and then only you can start working for the employer..... -

Doubt regarding Client letter for h1b Extension
Chitown01 replied to deepak.kumars.1988's topic in H1B : General
They will surely want client letter..... You can try asking project manager to write down on a plain peice of paper even that will work as long as s/he signs it with date and duration and allll... Without client letter it will be vry hard to get approval -
What are the chances of Visa reaffirmation? Depends on the facts of your case And how long will it take? it might take MONTHS to get reaffirmation What are the chances of applying for H1 transfer through the vendor for the same client while this case is in pending status? A new employer (vendor) can file h1b petition on your behalf... No one can predict the chances of approval however if it gets approved, you still need to get stamping done.

There is nothing to worry... if your attorney does not receive the notice in 2 weeks ask them to call uscis

Attorney will have to attach a new LCA with new details and as long as there is E-E relationship, you shoudn't have problem -
Will it be any problem for me with the uscis? NO
-
As long as your husband maintains his h1 status and you are not in violation of your h4 you can stay.
-
There is NO grace period on h1 You are out of status on the last day of your work. 60 days grace period is for f1 students and NOT H1. Contact an attorney asap.
