  2. Hello All, On April 02, my employer received notice of Intent to revoke on my current petition. The reason is my employer haven't filed Amendment for my current location since 18 Months. On April 30, my employer responded to NOIR apologizing USCIS and sent proofs of my employment. Simultaneously, to be on the safer side, I did a H1B transfer with company B and got acknowledgement receipt on April 26. On May 31, I see an update on USCIS website that my petition with current employer is revoked and the same notice has been sent to my current employer. I do have acknowledgement of the new petition from Company B.Is my status considered to be valid? This new petition is filed under regular processing. Should I expedite to premium processing to be on the safer side? Does this matter? Are there any chances that my new petition will be revoked too? If so, what will be my grace period? As fate continues to play, I got a full time offer from one of the reputed company. Can I do H1B transfer again using the acknowledgement I received for company B?
  3. Hello All, Here is my scenario. Can you please provide some insights. I am currently in USA on new petition. I am having some issues with my current petition. I am trying to come out of this mess. One thing which occurred to me was, I am having old H1B petition with some un-used time. I was in USA on this petition from Jan 2008 - Jan 2012. I left USA in Jan 2012(returned to USA in Sep 2016 on new petition). The old petition has validity till January 2014. So technically I am having un-used time of 2 Years. But, the old employer revoked my petition. So is it possible to reaffirm the old petition and do H1B transfer? Thanks in advance.

    Thank You. The thing is employer not willing to disclose the details. He is assuring that it is not fraud. But he is not willing to share the NOIR. I tried a lot. He agreed to answer NOIR and in mean time I am doing H1B transfer. I will keep posted.
  6. Hello, Here is my current situation. Can some one please help me with this? I'm employee of SCE and I'm having approved H1 B petition until August 31st 2018.I'm working in E-V-C Model. Journey of Events In January 2018, Vendor agreed to hire me as Full time employee from April 1st for them with the approval of the employer. My vendor has made a contract with my employer till Mar 31 2018. Vendor initiated processing and filed LCA on March 12th 2018.And also agreed to file my H1 B transfer in premium processing. On April 02, the employer received NOIR on my petition.The reason for NOIR is not filing Amendment with my current client location.My Employer informed that USCIS made a site visit to the location mentioned in the LCA. The deadline to respond to NOIR is by April 30.Employer is neither ready to respond to USCIS nor has shared the NOIR with me. My employer argument is, I am not his employee any more as I am moving to my Vendor starting April 1. So here are my Questions In this situation can i go ahead and continue with my H1 B transfer process with my Vendor? What are the chances this NOIR impacting my new H1B transfer petition? What will be the implications, if NOIR or RFE affects my H1B petition? What will be my other options to remain in status? If in case nothing works out, what would be maximum days I can stay in USA after notice expired?

  12. Hello All, My employer said he received NOIR due to not filing H1B Amendment to my client location. He mentioned that he hass given till April 31 to answer on this RFE else my Petition will be cancelled automatically. Other than this he is not sharing any further details. He also mentioned to me to look for another Employer as he doen't have an answer to the RFE he received. I doubt some thing is not correct here. He might be in big mess and covering this up. I checked in USCIS case status and I didn't see any thing saying about NOIR. How to make sure what exactly he received in NOIR? IS there any way we can reply to USCIS or at least apologize for not filing H1B?

    Hello, Thanks for the reply. But my situation is little different, I would like to goto visa stamping 4 months prior to my visa expires, since I already have an extended I797 for 3 years. In this way, in the future I will not have to goto stamping for next 3 years and will be easy to travel in and out of US. So, can I goto visa staming with valid I797(expires Aug 2017) even though I currently have visa stamping till Aug 2014 ? Thanks!

    H1B renewal stamping

    Hello, I have a valid I797 and visa stamping till the Aug end 2014. However, I already applied for my I797 extenison and got it approved for next 3 years. Now, I am planning to travel to India this month(April). Since I already have new I797 approved, can I go for renewal of H1B visa stamping in India? Is it ok to go for H1B renewal stamping, before 5 months even though you have valid visa stamping ? Appreciate your help and responses. Thanks!
