  1. Hi, I just joined a Indian consultancy firm in California. During the initial talk with HR, I was told that as per my job level I will be non-exempt and will be entitled overtime pay. I signed the offer letter and joined the company. after I joined, I reviewed the offer letter to find out that I am classified as exempt. Now, when I asked them to change it they say my role is classified as exempt. I understand there are some CA labor laws which define this. But, I want to confirm that my role is indeed a exempt role. How do I find this out? Please advise.

  4. Hi, I have accepted an offer from company B and initiated a H1 transfer(regular processing) from company A to company B. I would like to take break of 1 week after my last day with company A and then join company B after gap of 1 week. Am I allowed to do so? what would be my status during that 1 week? will I face any problem during my H1 transfer process? Please advise Thank you

    Ok. If I choose to join 2nd company and initiate my transfer (while my transfer with 1st company is in process),then while 2nd company transfer is in process, the 1st transfer might get approved and I enter H1 status. But, I am not getting paid because I am not joining company A. Wont I be out of status?

  8. I was on H1 two months back. My H1 stamping got rejected and I came back to US on H4 visa. I got a offer from company A and they initiated H1 transfer under premium processing. While my H1 transfer is in process with company A, I am expecting another offer from company B. I want to accept offer from company B and initiate my H1 transfer with company B. By the time, I accept the offer and initiate transfer, I might get the approval from company A. Now, I might end up in a situation wherein I would have two H1 approvals. If I decide to join company B, what would happen to company A approval. Will I-9 form decide which H1 becomes active? Will I face any issues? Thank you.

Does submitting i-9 brings me to H1 status ? Whats would be my status after H1 approval? I have another good offer and now, I am thinking of accepting this second offer. Can I initiate H1 transfer with this company as well and reject the first offer? I might end up in a situation where in I have two H1 transfer initiated against my name? Will there be an issue?     Change employer while in 7th year | I-140 approved

  13. My spouse entered his 7th year of H1 in Jan 2012. His I-140 (EB3) is approved. His current H1 petition is valid till Mar 2013. He may get 3 years extension after Mar 2013 since his i-140 is approved. Can he change his job now? what is the risk in changing his job now? Does he have to look for same job description to retain his priority date? Can a new employer file for his GC under EB2? Thank you.

  15. I am filling out DS-160 form for H4 visa. 1. In DS 160, it asks for Principal applicant. Are they asking for principal applicant of petition or principal applicant of H4 visa? Should I enter my name or my spouse name (H1 applicant)? 2. Next they ask for Petition number. I have two petition numbers - H1 of my spouse and my H4. Which should I enter? Please advise. Thanks
