  2. Hi, I am currently having I-140 approved and in to 12th year on H1B(extension based on i-140). Currently, working in Company A and my H1B is up for renewal by Sep 1st 2018. I-94 and Visa are also valid till Sep 1st 2018. My company A has recently initiated H1B extension and will take another month to apply with USCIS. In case of the petition rejected or denied by USCIS(in view of the recent RFEs and denials I am hearing from my friends), can another company B apply H1B transfer+extension after Sep 1st or later. Is the rule of 60 days post I-94 expiry applicable here? If yes, does that mean that if Company A's H1B extension goes beyond Nov 1st and gets denied, I am out of options and have to leave the country? If that is the case, is Premium processing a better option? I am in a technical Manager role so not sure if there are more queries nowadays from a managerial role standpoint. Please help and guide me in the right direction here as I still have a 4 months left from now and have an option to ask my employer to file the petition in Premium processing. Thanks for your quick response on this.
  3. Hi, I am working for company "X", which has been recently re-branded to be called as company "Y". There is no change to the Employer identification number and is just a name change. I have also been promoted from Team Lead to Supervisor. No change in roles & responsibilities in general. My approved H1B petition shows Team Lead as title and company name as "X". We have all the necessary documentation regarding the name change from DOL. I can get all the required paperwork from my HR prior to travel. My current Visa(Listed as company "x") expires in Sep 2018, and I wanted to check if I need to get my VISA stamped in case I travel out of country before the current visa expires. I am planning to visit India in the month of December 2017 and wanted to be prepared. Your quick response is highly appreciated! Thanks!

  5. Hi, I have been working in company A as "Team Lead" and will be promoted to "Manager". I am currently on H1B having approved I-140. I have my H1b extension coming up and my company is planning to promote me to Manager. My 6 years on H1b have been already over. My current Team Lead job description does have some managerial roles and responsibilities in addition Design, Development, Testing & Maintenance of applications. Does this pose any issues to my H1B extension or current approved Labor/I-140. Does my company need to file for a new Labor/I-40 or with changes to immigration policies, my job description and title no longer has to be the same for ever till I get my GC. Please help me at the earliest. Thanks!

  9. Hi, I am working in Company A and as part of their branding exercise, they change the name to "B". My paystubs and W2s now show company name as "B". My I797 shows Company name as "A". I have my I-140 Approved under Company Name - "A". I have my current I797 extension and VISA stamped on company name - "A" valid till 2018 Sept. Here are my questions: 1. Does my company need to file I-140 amendment stating the name change? 2. Does my company need to file H1B amendment stating the name change? 3. If the answer is yes for 1 & 2, will there be any issues at port of entry if I travel out of country and come back before the amendments are done? Can I just carry the official documentation about the branding-name change from my HR along with any supporting documentation from Govt. about the name change. This is only in case POE authorities ask. Generally, as long as I am with the same company and with Valid visa there are no issues I suppose. Appreciate your quick response. Thanks for all your help.

  11. I have my visa stamping scheduled at Hyderabad consulate and wanted to know if I can take my Infant daughter along with me and my wife. My baby is a US citizen and is not an applicant. The problem is she is only 8 month old and will not stay at anyone in India as everyone is new to her. Please suggest.

    Congratz on your visa approval. I have a question regarding the timing of biometric appointment. At what time was your biometric appointment? Do we have to have 24hrs time gap? I have my visa appointment on Oct 5th at 9:30AM and biotmetric appointment scheduled on Oct 4th at 1:00 PM. Is that ok?
  14. Thanks for the update Cipher. Congratzz!! I am in the same boat. I have sponsored visitor visa for my in laws back in 2012 and got rejected as they took some time to give the VO the right document. :-( So, this time, did you sponsor them or they went through the self sponsored route.. If it is self sponsorship, did they take the help of any Mediators or Brokers back in India for documentation / paper work. Please let me know.
