  1. Hello, I am currently working on H-1B visa but due to my medical health condition, I need to take Leave of Absence. I have been with this new current employer for only 3 months so I am not eligible for most leave benefits offered by my employer. I wanted to check on below: 1) Can I take unpaid medical leave of absence and be legally in H-1B status with my current employer? 2) If so, how long can I take this leave for? 3) I am almost on my 6th year of H-1B (expiring in 07/2017) and this new employer already started my GC processing. LCA is completed and they are moving to next stage. Will this leave of absence impact GC process? Any advise on above is greatly appreciated. Thanks, RM
  2. Hello, I have a question on my upcoming travel plans to UK. I am currently working on H-1B visa in the US; and have a valid I-797/I-94 expiring in 02/2016. I got imy H-1B this year, and thus have not got it stamped on my passport. I also have a US tourist visa (B1/B2) valid till 08/2016 (this is stamped on my passport). My old I-94 card as stamped on the passport was valid till Sept '2012. Can I travel to UK without getting my current H-1B stamped on the passport? Would I be able to get UK tourist visa and be able to enter back into US on my visitor visa? Please advise. Any help would be greatly appreciated. Thank you.
  3. Hi, I have a question about my situation. I got my H1B approved in October 2009 and then worked for 2 companies on H1B visa. I got laid off from my company (lost my job) last year in November 2011 and thus transferred to H4 visa. Now if a new company wants to sponsor me through H1B visa, is there a time restriction or cap limit I am subject to? Also as I have been out of work for more than 9 months, do I need to provide the paystubs from my old job? In addition, what other problems can I face from the transfer of H4 to H1B? Thank you in advance for your help.

    H4 to H1 visa

    Hi, I am currently on H4 visa since January 2011. I was previously working with a US company from October 2009 to January 2011 on H1-B visa. Now, a company is ready to hire me and wants to change my status from H4 to H1B visa. I wanted to know how much time (weeks/months) it will take for the employer to change my status from H4 to H1B visa? Also, can I work with the employer legally once my papers are filed and I am waiting for the changed status. Please advise. Thank you.
