  1. All, I have sent interfile request in Feb. I recently checked the status with USCIS and what they see is my I485 still has 2 I-140(one for Eb3 and one for EB2). 1)Does that mean they have attached my latest EB2 approved I140 with I485 case. 2) My I 485 application is still in Nebraska and EB2 I-140 was filed in in Texas. Do they need to be in same location and is that something interfile request covers that? 3) Is there any rule about waiting for 180 days from interfile before I change job. I am ONLY on EAD so my understanding was I can change job anytime since my I485 is pending since 2007.

    could some one please explain what could be the issue about interfile? Attorney 22 has written something which i am not sure "you will want to inform the attorney you speak with whether or not the interfiling request was filed while your priority date was current and if this new position is with the same employer who filed your EB2 petition, or with a different employer." We did file Interfile but when I checked with Immigration level 2 officer, he said he can see 2 I-140(one for eb3 and one of EB2) ...thats all. My company is NOT going to revoke my I140 for Eb2 ...I want to understand what issue could be if we have requested for interfile and its less than 180 days. Its urgent because I am looking to start new job in 1 week.

    Hello Attorney, This position is with different employer. I recently file Interfiling request on Feb 5th and yesterday when I call them they said still my I1485 is showing 2 I40s. One from EB3 and one from EB2.. What is your concern about interfiling?

    Attorneys, Please respond. In my case one attorney is saying its OK and another one saying its role and resposibility is different and salary is high(since it has commission component). Its bascially moving from Software engineer position (as filed in Labor) to Technical Account Manager(sales + development role)
  6. Hi, MS in CS from US. EB3- nov 2004, (as Programmer Analyst) Working only on EAD on since 2007. No H1B renewal since 2010. New EB2- labor - approved, 2012 (As software Engineer) New EB2- I140 - approved, 2012 Dates Ported to Nov 2004. Interfiling done. Waiting waiting and waiting to get current and hoping everything goes fine. I have accepted a new Job. Its in same field(s/w developement, services and even technology) but in my Role its design, development and strategy but it also includes Business Development and Account Management so compensation has base + commission listed in my offer letter and showing as role needs getting new clients, sales but its all in IT services along with Development, coding, strategy etc. New company lawyer says AC21 should be fine but are there any concerns some one has faced in situation like this. Please suggest. Thanks

    New H1B OR Transfer

    Hi, In Oct,2004 I applied for my first H1B and had few h1b transfers since then. In 2008 I moved on EAD and didn’t renew my H1B afterwards. My last H1B was valid till 06/18/2010. I have Perm and I140 approved. Given that right now my application is pending and I am only on EAD, to be on safe side If I want to apply for H1B, will it be transfer or New H1b (outside of Quota)? Since I have I140 approved, I should be able to get 3yrs of H1B? Thanks

  10. Hi, I have a EB2 case(Software Engineer) position. I am looking for get a role in consulting as Manager but salary diff could be 50% more.. Job duties are still technical work and infact same filed or product. Does Title and salary Hike could be an issue during AC21 Portability? Thanks

    Responsibility of company

    Hi, Finally I think I got the job which I was looking for. This job is Senior Manager with pay could be double of whats listed on my EB2 labor. I have a question, Do I need to tell new company to file AC21 portability? or I can do that? My work is going to be in same technology but title and salary, benefits are all different..Please help. Also since I am only on EAD and I have never used my all 3 yrs of H1B, Does it makes sense(to be on safer side), to ask them to transfer my H1B also. So that I will have H1B as an option incase something goes wrong.. Belle, Hope things will work out :-)

    So my lawyer has filed Interfiling also both for me and my wife.. but no guarantee that they will shift the file since there is no actual process. All he can do it just sent letter to request to transfer the files. So if I change job and file AC21 portability with new employer, they should be able to respond to any query if need to and represent my new EB2 case which has my old dates ported and I1485 file. What I am trying to understand is , Do I need to mention EB3 case at all my new employer ...so should I simply explain that I am on EAD and I have EB2 I140 approved and I1485 filed and waiting..

    Hi, I want to know if someone is on EAD(6 yrs) with I485 filed, I40 approved , what is the responsbility of company at this state getting GC. FYI..I have a complex case but so far no issues.. MS from USA. EB3 - Nov 1, 2004 (it was a substitued labor). EB3 - I140 approved, I1485 file in 2007 Working on EAD , No H1B. changed company last yr , they filed new EB2 Laor- approved. I140 - Approved. Port dates from EB3 - Done. On EB2 I140 approval notice , its showing Nov, 2004. Interfiling - This week or so. ONLY thing is wait for date to current and get result...Anything else remaining? Can't a person just go and join any company while waiting for GC, file AC21 and at time of GC if there is any issue...just hire a LAWYER and get it resolve...if no Query then get GC and move on. What I am not sure is company's responsibility since I m on EAD past 6 yrs and there is nothing company is doing so why should I stick to it if I get somethibg better? Please response.     Thanks Belle, What are your recommendations? I have an oppurtunity which is very good but i don't know if at this stage (few months away from GC), i should be changing employer. but problem is noone knows if its few months vs. few yrs. I have I140 approved of EB2, can I do Ac21 based on that? Since my I140 has old EB3 dates and I485 is already filed back in 2007. Please help..Its urgent
