  1. Hi, I had successful visa stamping done on June 4th in Vancouver. Questions asked: Where do u work? Who is ur employer? Is ur client site same as ur employer office? How long u have been working for your employer? How long u have been in USA? Thanks!
  2. Your case sounds unique to me. If I were you, I would go to India for H1 stamping. It sounds like a pretty good case for an RFE in any other country (Canada or Mexico). If the client is supportive, I don't see why you would not go to India for stamping and hope your visa is approved right away. Talk to your attorney but wish you well!

    Urgent help needed for question reg payment

    I believe, you would need to mention the Base Pay to the visa officer. The base pay is the amount specified in the LCA. If they ask you about the extra payments, you can mention that, they are bonuses and incentives that your company pays on a periodic basis. The extra payments should not be an issue as everyone working on a hourly basis will have fluctuations in pay at some point or the other. I don't see that being a problem but you could also confirm the same with your attorney.
  4. I was in a similar situation a month ago. You do not need a visa again. Your old visa should work until 2014. If you are traveling out of the country, make sure you present the CBP officer (at the port of entry in US) with your new I-797. You should be good.

    Paystubs with different hourly rates

    @namexyz: I was asked the same question about inconsistencies on my paycheck a couple of years ago when I went for my stamping. I just told the visa officer that, my employer pays out incentives and bonuses from time to time (on a periodic or random basis) and the inconsistencies reflect just that. You may want to answer in a similar fashion if asked.

  8. Hello Experts, I have a Master's Degree but my company filed my I-140 in EB3 category because I had No work Experience then. I have a Priority Date of Dec 2009 under EB3 filing. I now have about 3+ years of work experience, as of today. Can I now slide from EB3 to EB2 and at the same time file I-485 IF my date becomes current in Feb/March? I am hoping I can carry forward the same Priority Date of EB3. Looking forward to your advise/suggestions. Thanks in advance for your help! Jaggu.
