  1. Hello ! I have applied for I-485 (with I-765 & I-131) based on EB1EA I-140 approval. All these days I am working in a different field other than my field of research and volunteering a professor in his research based on my publications and recently submitted a paper for publication. My EB1EA I-140 got approved based on my publications, citations count and journal article reviews within 5 months without any RFE. After getting EAD also I have not started working in my field of research and waiting for I-485 approval. 2 months back I got RFE and asking for proposed job offer letter in my field of research and updated medical records. For answering the RFE, myself(Co-PI) and the professor(PD) where I am volunteering are writing a grant proposal on a project for a national organization and that professor is planning to hire me after the grant approval. Now the he is providing me two letters 1) a letter on the university letterhead to USCIS saying that writing a grant proposal with his signature and 2) a tentative offer letter on the letterhead to me saying that he will hire me after grant approval which mentioned yearly salary, all possible job duties and there is not a specific start date and without his signature. My attorney is asking for signature on the tentative offer letter also, is the signature needed ? All together does the proposed offer letter needed for approving my EB1EA I-485 ? Please advise, Thanks !

Hell all, a startup company is planning to provide me a Research Associate job and an offer letter in my field of research, however the company President is saying that the company has to go through DOL for a Labor Certification (LC) and 30 days job advertisement to prove that no qualified US worker is available for this position, is it true ? I already have an approved EB1-EA I-140 and EAD also. Thanks !

    I-485 process/adjudication delays with TSC

    Hello all, what should be the prevailing wage or minimum wage according to poverty guidelines for I-485 for a family of 2 adults and 1 kid, before getting a proposed offer letter from a prospective employer in my field of research. Just I want to avoid any additional questions from USCIS. Thanks!

    Received RFE letter on 11/09/2015. Asking for current job offer letter in the field or research, start date permanent or full time and salery. Also asking for latest medical records.

    USCIS online status updated to RFE sent on 10/29/2015, however till 11/3/2015 no RFE letter is received either by me or by my attorney, any guess ?

    My attorney raised a 2nd service request on 16th October 2015 and today we got automated USCIS email saying that they gave an RFE on both my and my spouse's pending EB1A I-485s. I will update here after receiving the RFE letters. Any guess for all possible reasons for RFE. Are medical records submitted for I-485 valied only for one year ?

    AOS or CP

    In general, it's IMPOSSIBLE for EB1 to be backlogged, however it may get delayed because of excess number of applications filed with service centers and different service centers have different time frames for processing I-485s. My EB1A I-140 was approved on August 5, 2014 and applied for AOS with TSC for me and my wife on September 5, 2014, got EADs & APs in December 2014. Still waiting for I-485 approvals. Yesterday TSC updated their I-485 processing time frame to November 23, 20104.

    Hi bv2006, Yesterday TSC changed their processing date to November 23, 2014 for all employment based I-485 applications, application received date in my case is September 5, 2014 with TSC, still my case's status is Finger printing fee received and no other update, any guess for the delay ?

    Validity of EB1 reference letters

    Yes, there is no expiration for recommendation letters. I drafted recommendation letters in such a way that they will be useful in the same way for both NIW and EB1A I-140 petitions. Your case is sureshot for NIW. 3 years back I am in the same situation, applied for NIW I-140 with 4 publications, 68 independent citations and only 1 journal review and got the approval within 30 days. I had to wait for 18 months for improving my citation count to 77 and journal review count to 25 and then applied for EB1A I-140 and got it approved within 5 months. All recommenders helped me in changing the date on the letters before applying EB1A except one recommender and I had to use the old letter without any date change. I took help from the same attorney for both NIW and EB1A.
  11. Hi, Try to contact by email as many persons as possible who cited your publications whom you know only because as they cited your publications. Few will be ready to help and few may not help. External recommendation letters from other countries will be very much helpful which states your research is globally useful. I had 3 external recommendation letters, 2 from another countries and 1 from with in the United States and it worked well for me.
  12. Hi, My EB1A I-140 was approved on August 5th 2014 and submitted I-485 by September 5th 2014, completed finger printing on September 30th 2014 and got EAD & AP by December 5th 2014. Still today waiting for the I-485 approval. SR response is "in line for process/adjudication". Please some one can explain possible reason for the delay, will the medical records expire after 1 year of the submission of I-485 ? Or there any general processing/adjudication delays with TSC ? Or as its nearing the end of fiscal year, are they run out of visa numbers temporarily and waiting for the release of next fiscal year's visa numbers ? Or any other reason ? Thanks

Hi, I need help with the list of documents needed and list of questions asked for B2 visitor visa interview at the Hyderabad U.S. consulate for a 30 year male and 25 year female newly married couple. They plan to visit U.S. for 2 or 3 weeks. Male is a chartered accountant who owns an accounting firm. His brother and sister stays in the U.S. on H1B visas. Patents has B2 visa and visited U.S. several times. Male has property and house in India and has to take care of parents. Any help is appreciated. Thanks Reporter

    Advertisement for EB2 PERM

    My friend's advertisement in Sunday news paper is like MS, 3 years exp (or equiv) and it got denied after audit. The reason is that BS is not mentioned and the officer says not mentioning BS means discouraging BS candidates.
