    An audit is actually a very common request from the Dept of Labor and does not mean that your Labor Cert will fail. It is simply the DOL's request to see the "work" done in preparation to the Labor Cert's filing. Whether or not you wish to work with another employer who is willing to sponsor you for a Green Card application is a separate issue. Switching to another employer does not guarantee that your Labor Cert with Company B won't get audited as well. Audit issuance by the DOL has increased in the past year.     No, the U.S. employer does not have to wait until the H1B is approved before starting the Green Card process. Both can run parallel to each other.     In general, one does not have to be employed by the U.S. employer for that employer to sponsor the individual for a Green Card. However, the employer and the individual must intend employment (and then must actually do it) once the individual's Green Card is approved. The Green Card sponsorship is just like an H1B sponsorship - you must find a U.S. employer, with a position available in which you qualify, to sponsor you.     EB2 eligibility

    It seems that you and your employer may be confused. The employment-based Green Card application is technically for a future position, so even if you are not currently employed in the higher level (i.e., higher requirement) position, they can still file an EB2 application for your so long as they actually have an EB2 position in which they have need for, and you qualify for such position. However, if the company wants to employ you now in a different position in H1B, then that is something you both need to decide on for your H1B that is a separate issue from whether or not an EB2 Green Card case can be filed.     If Company A and you no longer intend to be employed in a fulltime, permanent position once your Green Card is approved, (and will actuallly do so) then you no longer have a Green Card case with Company A.     The DOL does not allow an individual to use experience gained while on-the-job with the sponsoring employer in order to qualify for the sponsored position in the PERM application.
