    h1b old petition expired- uegnt

    Hi, I have been on L1B for around 3 years.Can I use my expired H1B petition which was approved in 2005. I never used that petition.Some sites say that I have to on H1 status within the last 6 years inorder to use the petition. Can you please help ? Thanks and Regards Gaurav

    H1-B 6 year clock

    Thank you all for this.The unfortunate part is I donot know the receipt number of the approval notice.Our HR department told me that my H1B was approved.I just came to UK at that time and didnot know what to do.I just kept silent. I have left the company through which my petition got approved.I donot have hope of getting my receipt number of approved petition. Is there a way that I could get it ?How long does it take to get the copy of approved petition.If my company revoked it,would I still be in cap exempt H1B ? If it was applied in lottery,can I still use that petition.

    Dear Murthy Law team My firm applied for my H1B in 2005 which had got approved. However I never came to the US on that H1B petition. My company later applied for my L1B and I travelled to the US. Now, i.e. after almost 8 years, I want to reapply for H1B. My old H1B petition is expired. But, can I apply for H1B now without coming under cap or am I still cap eligible?     L1B to H4 COS

    I am on L1B in the USA for past 2 years. My L1B visa has expired but I94 is valid until august 2013. My wife has got her H1B approved recently. Can I apply for H4 COS from a future effective date i.e from say Mar 2013? I want this from a future effective date because once I get approval notice from USCIS for my H4 (effective from Mar 2013), I have enough time to resign from my current employer. Kindly help asap.

    Are you really sure on this @Immigration Seeker .Noone ever said that you can join before your H1 gets approved.

    These days we have so many L1 B rejections.I didnot file L1B extension. Also I was planning for H1B when L1B was getting expired.I didnot want to mess my H1B with L1-B.Also could you elaborate what do you mean to say "Yes you can continue to work on H1b from the moment COS is filed.".As per my understanding one can work on H1b only when the H1B petition gets approved.I am confused now.Pls explain

  12. I see that L1-B is expired but I-94 is VALID.Now if company X files H1B for me and if it gets approved,can I work in US on H1 without getting it stamped. Or Do i need to go to India,get it stamped before I can start work in US
  13. Please see that my L1B has expired and I am on L1B blanket with I-94 expiring in 2013 August. Now,when I apply for fresh H1B through company X and if it gets approved,will i have to get it stamped before I can even think of continuing work in US with company X. Can i continue to work in US before it getting stamped.
  14. Hi, My L1 is expired, but Blanket petition is valid. My I-94 is also valid. I am with employer A currently. I had applied for L1 to H1 COS through employer B. It got denied.
