  1. Hi, Our attorney filed my wife's H4 EAD renewal application earlier this year (March 29th, 2018) , which was approved on May 27th , and the card was mailed out. For some reason USCIS mailed her EAD card to my work address and it got returned to USCIS. We discovered this discrepancy in mid-June and immediately updated the address to our home address and submitted the request to re-send the EAD card with USCIS. We have in-fact received another letter in the mail from USCIS stating they have received this request , and will mail out the new card with in 30 -120 days. Her previous H4 EAD card expires on July 15, 2018 , and HR in her company is requesting documents. We have furnished all the documents we have , approved H4 visa, approved H4 EAD notice, letters from USCIS but they aren't willing to accept it . What other document can we use to prove. Kindly advise. Thanks Nitin
  2. Hello all, I am interested in having my parents (retired) visit us during the Christmas holidays this year. My parents are raising my 5 year old niece from my brother who has been separated from her wife for the past 5 years. I understand visa application process for my parents should be pretty straight forward. How should I address the documentation for my niece, considering my parents haven't received official guardianship for her yet. Should I schedule separate interviews for my parents , and my brother + niece. I am planning to go to India this fall , and will need to get my visa stamping done at the embassy as well. In this case, can we all plan for a single interview at the consular office ? Kindly advise. Thanks
  3. I have been working in US on H1B visa since the past 9 years, and presently waiting for my priority date to become current. As a hobby, I do financial analysis of public companies to discover investment opportunities. Recently I have made contact with a research group that liked one of my investment idea and wants to present it to an institutional money manager. If investment idea generates profitable return for the money manager, profits will be shared, and research group wants to find out if profits can be split in three. It is my understanding that on a H1B visa I cannot accept any payment outside of my work , but I am curious to know if my share of profits can be parked in a trust account that I can withdraw once I have my green card issued. Would appreciate your advice on my current situation.

  5. Recently, I have been presented two opportunities with my current company, among which first is vertical advancement from project engineer to a senior project engineer opportunity. Whereas, the second opportunity is more of lateral move with in the company to strategic marketing position. From my personal long term career interests, I am more inclined with the later but unsure of how the immigration process could get affected. Need insights on how a lateral move can affect my green card process - with I-140 already approved through the same employer.
  6. I have been presented with two different opportunities with in my company recently. First opportunity is inherently a sequential vertical advancement from Project Engineer to Senior Engineer level, where as the second one is more of lateral move into a different function : Business Strategy Development. By training, I am an engineer but more inclined towards Strategy development function , unsure about how my immigration process will work in that scenario. Considering my I-140 application is pending for approval ( filed by the same employer), I want to know what bottle necks I run into if I accept this position.
