    H1B amendment due to relocation

    Dear members, I am moving to other city and following question was asked by Attorney to my manager or H1B amendment ( due to relocation)- Export License: Please check which of the two statements applies to the foreign national you are sponsoring in this petition: With respect to the technology or technical data the petitioner will release or otherwise provide access to the foreign national beneficiary, USCIS requires an H-1B, H-1B1, L-1 or O-1A petitioner to certify that it has reviewed the Export Administration Regulations (EAR) and the International Traffic in Arms Regulations (ITAR). · A license is not required from either the U.S. Department for Commerce or the U.S. Department of State to release such technology or technical data to the foreign national. · A license is required from the U.S. Department of Commerce and/or the U.S. Department of State to release such technology or technical data to the foreign national and the petitioner will prevent access to the controlled technology or technical data by the foreign national until and unless the petitioner has received the required license or other authorization to release it to the foreign national.   2. Hi, My Employer is working on to port my case from EB3 to EB2. I have traveling job to support my clients and I am not in IT. Now I am looking to relocate to another city to avoid less traveling. Would it effect my EB2 porting process if I move before it is all approved? Thanks Raj

    Passport validity

    A passport valid for travel to the United States with a validity date at least six months beyond your intended period of stay in the United States. I have my passport valid till May 2015 with few blank pages left on it. I am planning for my H1B stamping but I am not sure if I have to apply for new passport before visa interview, based on 6 months beyond my intended stay rule. My I-797 been approved till july 2017. Please help me.. Thanks raj

    H1B expiring in 6 months!

    Also I just wanted to know, in worst scenario if I dont get my PERM approved within my H1b expiration, would my labor process be dropped as soon as i leave US or it would continue and I still have the chance to come back after my PERM approval. Please let me know. Thanks Raj

    H1B expiring in 6 months!

    Hi, My H1B is expiring in 6 months and my current GC status is undergoing news paper and website add. I was wondering if my PERM and I-140 would get approved on time? Should I keep up my hopes or start packing up my bag? Though my company attorney is saying we are still on target. Please advice! Thanks Raj

    Visa Stamping

    Dear Senior members, I have an important question to ask you. I have a family marriage in Jan 2012 in India and I am thinking of attending it. I have my Visa stamped on my passport from Com A till Aug 2012. But I chnaged job to company B and then to company C after I came back from India in 2010. So, can I go to India and come back on the same Visa and show my new I-94 and I-797 at the port of entry in US or do I have to take a fresh stamping in India? One of my friend told me that I need not take new VISA stamping as long as I have my Company A Visa stamping is valid( Aug 2012). Please Help! Thanks Raj
