  1. Hello All, I am applying H4 EAD for Spouse. Couple of questions regarding that:- 1. I am on H1B and have an approved I-140. I am in the process of transferring to another company. What should we put in for Eligibility Category for my Spouse EAD application. ?? 2. Can we apply for H4 EAD Online ?? Is there premium processing for this application.
  2. Hello Friends, My in-laws are with us in United States. They are scheduled to return back in March last week. Their Visa is eligible upto April 9th. We are planning to apply for extension and postpone their return due to Corona Virus. Quick question on I-539 Form for extending I-94 for my in-laws:- In the I-94 and Visa First Name is FNU and Last Name is Full Name. In the Passport the First Name is Full Name and Surname is blank. In the form I-539 it asks for first name and last name. What should be filled for First Name and Last Name. As written in I-94 or passport ? In the form it says the name should be as mentioned in the Legal Birth Certificate. I am confused. Please guide me through this.
  3. What is the quickest way to convert to F1 from H4. My H1B has been denied and my wife is on H4. She wants to convert to F1. Is there a way we could put it in premium processing. Please let us know your thoughts !
  4. Hello, I have recently filed an H1B Extension and have been issued a RFE. Our lawyer is trying to respond to the query. Meanwhile, I would greatly appreciate if you guys could answer my questions:- 1. What are my options if H1B is denied. I have been told we could file a new petition ? What else are our options. 2. I heard that if I have an approved I-140, Employer can file a Cap Exempt H1B petition based on the approved I-140. Can anyone explain this ? 3. If H1B is denied, what is the grace period to leave United States ? Any other options you guys could suggest so I can prepare myself better to handle this.
  5. Hello, I recently applied for H1B Extension. I have already been on H1B for more than 10 years and have an approved I-140. I have a Masters Degree in United States as well. However I have been issued an RFE:- The RFE to put it simply is on Employer - Employee Relationship and Specialty Occupation. 1. What is the trend these days on H1B RFE Approvals. 2. How to prove Employer - Employee relationship - What are the suggested responses to prove Employer - Employee Relationship. As in what documentation might help to prove Employer - Employee Relationship. 3. How do we prove Specialty Occupation. - What documentation is needed to prove Specialty Occupation. I have heard it is very common for USCIS to issue RFE's these days but if an attorney responds they do approve it. What are your thoughts ?
  6. Hello, My Mother In Law's Passport is valid till July 25th 2020. According to our plan - she will arrive in US on October 9th 2019 and return on March 31st 2019. However when we are trying to book the tickets in Air India - we get a message "Passport should be valid for 6 months from commencement of travel". What is the rule about Passport Validity ? Should it be valid for atleast 6 months beyond the intended date of return (i..e March 31st ) or should it be valid for the duration of the stay. I did some research online and found a rule that India is a part of 6 month Club. So passport should be valid for the duration of the stay ? Given my scenario, would it be okay to book tickets till March 31st or should we make sure that when she returns she has atleast six months of Passport Validity.
