Hello All, I was laid off on Nov 09 (2022) and on WARN till Jan 13. Assuming the 60 day timer starts on Nov 09, the last day is Jan 06 2023. Question: - Should I start at a new place before Jan 06 OR an employer has to file an H1B before Jan 06 and the start date can be later (Jan 30 in my case). Will I be considered in status from Jan 06 to Jan 30 while USCIS is processing the application...? Thanks, DSan

Hello All, Appreciate feedback on my case. 1. Working with employer-A on H1B, filed for GC, I140 approved (Sep 2018). Continue working for employer-A for two more years (quit on Nov 2020) 2. Joined Meta. Applied for PERM which got audited due to Meta issues (well known). PERM was in the last stage of audit when I got laid off (Nov 2022). No I140 from Meta. 3. employer-B filing H1B now (Dec 2022) Question: - Do I need a I140 from Meta or the previously approved I140 from employer-A is ok? Appreciate any guidance. Thanks! DSan
