  1. Good Evening Members and Experts I was converted as FTE back in 2019. Due to professional commitments I could not travel to home country for visa stamping. 2020 due to the pandemic , US borders as well as US consulates were shut down. Now i am hearing there are visa appointments available at New Delhi consulate for late march/ early April 2022. That would leave about 4.5 months on my current I-797A. I have I-140 approved and eligible for 3 year further h1b extensions. Is it safe to travel with less than 4.5 months validity left on I-797A ?? or is it better to first apply for h1b extension in 2022 then go for stamping in 2022. Thank you very much in advance.
  2. Members, please please advice Also should i consult a lawyer from murthy forum?
  3. Also , this approval notice was received in July , but it only came to my attention yesterday that there was no I-94 attached. Have i already violated my status ??
  4. Good Morning I find myself in a spot of bother hence requesting assistance from members Briefly, my employer ( EVC model) filed for h1b extension ( 4th year ) in July 2016 and it was approved ( I-797 A notice of action approval notice with attached I-94 with validity from 08/29/2016 to 08/28/2017 i.e approx 1 year. In nov 2016, my employer filed for my h1b amendment due to change of client and hence change of location. Initially there was RFE for client letter which was arranged and employer duly replied back to RFE for H1b amendment. I kept checking online status on USCIS website using the receipt number and finally in May 2017 status showed as approved In July 2017 my employer sent me a copy of the approval notice, thinking it was approved i took a printout and kept it in my list of documents and did not go through it thoroughly. Yesterday i happened to go through it again and realized it is I-797 B notice of approval without attached I-94 I got concerned hence immediately contacted employer , he mentioned Yes , I -94 was not approved, but they have not received the denial reason and submitted a service request to USCIS. Upon receiving the letter, he will respond to USCIS. My biggest concern is i have read when I-94 is not attached then the person needs to go outside of USA immediately for consular processing and attend visa interview and considering validity on I-797B notice of approval is only till August 28th 2017 i.e another 15 more days, what would be the chances of getting a visa if at all any In the meantime, my employer did file for further H1b extensions in July 2017 and receipt number is already received. Also the notice of approval was received in July but it only came to my attention there was no I-94 attached yesterday only. Have i already violated my stay in USA and out of status
