  1. Probably this may be answered a million times earlier, but everyone's situation is different. My EB2 (India) I-140 is approved with a PD of 9-Feb-2012. In the latest bulletin (Nov 2023), my EB2 DOF is current but FAD is 39 days away. Also EB3 FAD is current for my PD. Should I stay in my lane or downgrade and file in EB3? I understand that neither option gives me a guaranteed green card in the next year or so due to the huge backlog, but just want confirmation from the forum to calm my nerves a bit. Appreciate the discussion. Thank you.
  2. I filed for a "Compelling Circumstances" EAD in June and was approved in September. Meanwhile, I joined an employer who filed for H1b which was approved in Premium Processing within 3 days in July, so I started a full time job with this employer. Can I concurrently work nights and weekends on my EAD? I want to earn extra money teaching robotics/astronomy to kids on nights and weekends. I want to keep my M-F 9-5 full time job with my H1b employer.
  3. Hi, I lost my job on H1 and am currently in the 60-day grace period. My last employer did not file H4 when I switched employers last year, so my wife has a valid I-797 from the previous employer, which is valid until Jan-2021. She has not traveled outside the US in the last 3 years, so her H4 passport visa stamp has expired. Is she accruing unlawful presence and what is the next best course of action? Appreciate your help.   4. My job was terminated due to an org reshuffle last week. I am on H1 with I-140 approved with a previous employer. What are my options at this time, given the global pandemic situation? I have student loans and will soon enter financial hardship. Can I apply for "Compelling Circumstances" EAD? Help and guidance much appreciated.
