h1b approved without change of status

Hi,

 

I was in india when h1b (without cos) was applied for me and it was approved (valid till 2017) after few months after I came to usa on f1 visa. currently i am working on opt. Now if i want to move to h1b status, does my employer just need to apply change of status for me (without me going to india) or do i need to go to india for stamping?

Either one is fine. COS within US is nothing but a new H1 but cap exempt.

So given the scenario that I was never on h1 status even though I had h1b approval, am i cap exempt ?

 

If i am cap exempt, am i cap exempt only with the employer with whom I have approved H1b or any employer can apply cap exempt h1b for me?

I think it will be cap exempt only for that employer, not sure here.

If your H1 petition was approved a couple of years back, please talk to the firm of Murthy. Why would an employer file your H1 petition and not expect you to join him?
