visitUSACanada Posted May 4, 2016 Report Share Posted May 4, 2016 Hi, I am a citizen of India, currently working on H1B visa, and my wife is a US citizen by birth. In 2011 my company applied for my EB2 green card, and in 2012 submitted I-140 for approval. In 2012 I got married, and in 2013 my wife applied for my Marriage Based Green Card (MBGC). We had the MBGC interview in December 2013, following which interviewer informed us about merging my GC applications, and also put my case under extended review. Since then, the case has been pending background check - and efforts like me (beneficiary) requesting to pull the MBGC application (to unblock the EB2GC), getting local senator to contact USCIS, my wife or I calling the USCIS have not helped. I have been with the same company for about 9 years now, and currently get annual H1B visas. I-140 is pending approval as well. The company’s request to expedite the I-140 approval was also rejected. Questions: 1. What other steps can we take to move either of the GC applications forward? 2. Is the MBGC application still in progress - if not, can my wife apply another one? 3. Any thoughts on what might be going on and what to expect? 4. Any other advice? Thank you in advance for any help/guidance. - S Link to comment

Additionally have a lawyer sue them or ask for a writ of mandamus from the courts. Get your own Lawyer, maybe the firm of Murthy or any of your choice. Link to comment
