Has anyone got H1 permit extension after that? Please update. My case was received around 09/15/2015 and my I94 date 92 09/30/2015. My attorney is asking to upgrade to premium. The 240 day rule is from date of filing or date of I94 expiration? Thanks, RK Link to comment

kalyan.gv Posted May 6, 2016 Report Share Posted May 6, 2016 Hello, I have my I-140 approved in June 2015. My H1B expired on Sep 30th 2015 and filed for extension. As am very close to 240 days I have applied for premium on April 28th of 2016 and today I have received RFE today. My question is if I have approved I-140 can I extended to stay beyond 240 days if I don't receive any status update with in 240 days of my extension? or I have to go back to India? Taj2980 Posted May 10, 2016 Author Report Share Posted May 10, 2016 Hi Kalyan, From what I have gathered ( attorney, other forums) , you can stay and work upto 240 days from the date of your I94 expiry. If the 240 day limit passes, then you can stay but cannot work, as USCIS is yet to give a decision on your petition. Hope that helps. RK Link to comment
