navr19 Posted May 1, 2016 Report Share Posted May 1, 2016 Hello, I am on H1-B with my current employer A with whom I got I-140 approved in EB2 category. Based on that my wife got H4 EAD and she started working.I have a better offer with another employer B but he is able to sponsor GC in only EB3 category. Questions: If I move to new employer B and ask them not to file GC, will I get my future H1-B extensions approved based on my old I-140 (Employer A told me that he is not going to revoke my 140, but he does H1B) ?If Employer B does not file GC then does it disrupt current H4 EAD status of my wife ? My wife is in India for vacation and won't be back until next month(Got H4 Visa stamped). If I accept the offer from employer B, once they start my H1 B and H4 transfer while my wife is in India. Will she face any issues at immigration in USA ? Please let me know, if there are any other issues in switching to new employer B ? Link to comment
